ZitZot: Google and Microsoft sued for links to filesharing sites

http://www.syncing.net/_images/products/files_synchronization.jpgMini music label Blue Destiny Records has sued both Google and Microsoft for allegedly “facilitating and enabling” the illegal distribution of copyrighted songs.

Filed on Monday with a US federal court in Northern Florida, the suit is an attempt to choke off the distribution of Blue Destiny tunes on the Germany-based file-sharing service RapidShare, also named as a defendant. It accuses RapidShare of knowingly running “a distribution center for unlawful copies of copyrighted works,” while claiming that Google and Microsoft are propping the company up.

According to the suit, RapidShare benefits from ad relationships with the two search giants. “RapidShare generates revenue by selling subscriptions for its high-speed download services, and through advertising dollars generated by its advertising partnerships with Google and Microsoft,” the suit reads. “RapidShare’s business success is accomplished only with the knowing assistance of these two top search engines – Google and Microsoft’s Bing.”

Nice try to get some money from Google and MS.
Rapidshare will fall sooner or later, but in its place 2 new file hosters will rise up.
RS defending line is that thay immediately remove illegal files when complaints received. And this line works fine until now.
We will see, but it is not an easy to start fighting with colossus like Google or Ms… You might get hurt in a process…

I use Megashares when I want to send or share large amounts of pictures or other file to my friends and family since the average e-mail only allows you to send about 10Mb.. depending on the service you use. These file hosts are a pretty important asset to the internet and will surely prevail, but will probably have to enforce laws or rules ratther, that are more strict when it comes to copyright infringment… eventually. We’ll see. till then keep posting MS links!! Its basically like letting your friend borrow a movie ya know!!

  19. chelmsley
    December 11th, 2009 | 22:43

wait a 1gb file in 20-30 minutes for MU? … im pretty sure i get similar with RS. But thats taking a 1gb movie divided into 6-10 smaller files which i can download 5 at a time, i would have a 1gb in about 20 i think

  20. justwondering
    December 11th, 2009 | 22:47

I heard it was a way to search Rapidshare servers for specific titles or files. Is this true? If so how?

  21. @ 17
    December 11th, 2009 | 23:02

@17 I can download 700mb movie from Rapidshare in around 5 mins, and im from the UK… it also does depend on your internet connection speed.

  22. adams
    December 11th, 2009 | 23:04

WOW, It sure has taken a few years, but I thought this would happen eventually.

  23. THeMaNRJ
    December 11th, 2009 | 23:12

So, RS hosts illegal content within their servers. So what? Everything or almost everyone downloads files from RS, MU, HF, etc. that are compressed. They may check file names, but not what’s inside. Change the file name to something else and problem solved. Blue Destiny Records is going for the easy cash, since most never heard of them or bought their music.

  24. BettyBoo
    December 11th, 2009 | 23:16

@21 700mb in 5 mins in the uk??? how??? I would like to know this, i suspect that 99% of the uk broadband connections can not d/l this fast

  25. THeMaNRJ
    December 11th, 2009 | 23:19

And what happens if I use RS, or any other service, for backup? I own thousands of CDs and they are fading away. So I make backup copies of them to be stored with these services. Is this illegal? And what happens if I want to retrieve them later. The music industry is full of BS! What they want is easy money, nothing else.

I hope they successfully sue Rapidshare then get their asses counter-sued by Microsoft and Google.

Rapidshare has gotten ridiculously worse over the past year…

First the dramatic decrease of premium member download allowances, then again… and now erratic performance.

Hotfile >> Rapidshare but if you’re smart you won’t waste time with any of Rapidshare/Hotfile/Megaupload/Megashares/etc — you’ll go straight to Usenet.

RS is one of the best out there until one of you cheap asses actually pays for a premium account rather than use the free service you can’t say anything.

  33. Netranger801
    December 12th, 2009 | 00:39

Yes, RS, there is nothing better and faster. I download a 700meg movie in 5 minutes…
As for money grubbing bums, why is that?
There are a business and businesses have make money to run business. And for what you, get it is WELL worth it.

  34. jesus shaves
    December 12th, 2009 | 00:50

I’m a premium RS user and I have never been capped at 5gb per day and I have often downloaded ridiculous amounts in one day. Plus you find almost everything on RS and I always get top speeds. The only thing that pisses me off is the “file can be downloaded 10 times” thing when you upload, although it’s easily circumvented.

Yes MU is has become the best free service and they have greatly improved over the past year or so. But being the best free service is just not a good business strategy. It just means that many will use it but only a few will pay for it.

As for the court case, I’m guessing this crappy little record label are hoping for a quick settlement because I can’t imagine many people uploading or downloading their music so their claim can’t be that high and they definitely don’t have the money for a long drawn out lawsuit. I would also presume Google, MS and RS don’t want a ruling that would set a precedence so here’s hoping they’ll settle.

  35. annoyed
    December 12th, 2009 | 00:53

    What a load of bullsh*t.

There are thousands of websites with RS links on.

Do they expect Google to moderate billions of results.
F**king internet censorship…it’s going to start getting like China

This ‘sueing’ tradition is starting to piss me off.

  36. Chester
    December 12th, 2009 | 01:01

And they think… They will get sales by this? I think that downloading generates sales. I know every single one of my favorite artist through downloading, I know all the cool movies, by downloading, and in the end, you buy what you like the most, not what you like in general. You can have over 2000 downloaded albums, and maybe 20 albums off all of that. Maybe a little more. But you like each and one of them.
Instead when u download like, no albums? Then you end up buying bad albums, and albums you dont listen to. yes, they want us to waste money ;)

  37. Caleb
    December 12th, 2009 | 02:53

Torrents are the way to go.

purchasing premium accounts is paying another person for pirated content.

It’s stupid and I hope they get sued till all the money they made is gone.

Sharing with each other, via torrents or w/e, at least no one is profiting off of it.

    December 12th, 2009 | 03:38

1st of all to all of you who don’t understand anything.

you are comparing RS with MU !! there is no way for that

1 – RS have the pause and resume for the uploads!
2 – great speed for download, i have 24mb ADSL2 and when im downloading the speed of the download is 3mb per second ! that mean 180mb per min, 10.8GB per hour! and you can find everything u want to find in RS but with MU, u need to search hard to find anything and it sucks !
3 – with RS points you can extend your account, i only did pay the 1st year then i never pay for the last 2 years coz i upload and other download it and i get points for that, and i renew my account for FREE ! does MU have this ? hell no !

so at the end RS rules!!! and MU suck my @#$@

pffft blue destiny ? wth are they ? I just read on the zitzot website about them trying to take down the links via DMCA, but one thing they gotta remember.. search engine spiders. To me it seems that Blue destiny indeed are trying to gain more monies by going after two major industries in the world wide web anyone with atleast half a brain would go direct to the file hosting site in question! Not a frigging search engine, Dont they realize that if the search engines put a block on certain keywords pertaining to blue destiny, then does that not mean that blue destiny goes behind the scenes due to not having many keywords ?So in order for people to actually find out about blue destiny then they would only be able to get to their site by using a direct url to their website, but as I said before! blue destiny who the hell are they ? so either way they still do not mean anything to me :-p

lol this is classic. Hopefully the big music companies will try to sue MS and Google as well (for linking to copyright material) and then the music companies will get their ass kicked.

The outcome would certainly be very interesting since they are always trying to take down torrent sites who only link to copyright material like Google does.

Google and MS will annihilate those bastards and then they’d have no say in torrent sites.

pfff, what’s going to happen next? so what? It is not my money that is wasting on the law suit. Their is always another site in replacement for rap!dshare.

is Blue Destiny Records (BDR) stupid? I can see BDR is no different than a gold digger. Ending rap!dshare or having Google/MS put on a filter, it is not gonna stop anything or do any better.

This is a purely compensation factor!.

  48. Infamous
    December 12th, 2009 | 14:03

    @42:

1 – Of course you can pause and resume with MU!
2 – MU can max out my 100Mb connection (which is realistically 80Mb), as can RS, so any difference?
3 – MU have the same system of using points to extend your membership, as well as earning money. However, they don’t expire like they do with RS, so MU would score better there.

Megaupload is unlimited, unlike RS with it’s unlimited package limited to 5Gb per day!! That’s very poor, especially as people’s connections get faster and faster, and file sizes get bigger and bigger. To download a blu-ray movie with RS, no matter how fast your connection, would take between 5 and 10 days (depending on whether 25Gb or 50Gb) etc

So really, your only valid point is that there is more choice with RS at the moment… But that is changing as people realise they’re getting worse.

Maybe you should do some research before spouting bollox in future? Make informed points?

    @52:

MU sucks. It force its premium users to download through MegaManager. Unlike RS which support general freeware like FlashGet which is the best download manager on the planet.
And you can download as many blu-ray as you like. All you need is some $ to buy traffic share package.

  56. iloveayumi2006
    December 18th, 2009 | 15:23

And by calculation, buying a real blu-ray disc movie is far more efficient than downloading a blu-ray movie. At least you own a physical copy and no hard disk space require for storage. The price of a 50GB space on hard disk is more expensive than a blu-ray disc.
