ZitZot: 15000 UK filesharers to get court order

More than 15,000 Brits who the music and film industries claim are ‘pirates’ may soon get legal letters accusing them of illegally sharing tunes, movies and games.

The letters are going to be sent out by ACS:Law next year and will tell the alleged filesharers to settle out of court for between £300 to £500 apiece or it will drag them before the beak in an embarrassing court case.

    How do you figure? Short of pirates not buying the products anymore, I don’t see how that would hurt the copyright holders, since hundreds of pounds per infringement, and I’m assuming that would be per song, would more than cover court costs and such.

    In the initial stages they will probably concentrate on chaser ‘uploaders’.
    How many of the dodgy trojan posts that sporadically hit the filesharing sites and usenet groups are likely to be part of some mad copyright protection guild ‘meisterplan’? Quite a few I reckon and that could be where these guys will come unstuck since most citizens correctly regard the planting of spyware and other malware a far worse crime than watching an ad free outta season TV show.
    As far as this deep packet analysis goes has anyone else noticed that SSL speed have dropped markedly over the last 12 months? It seems that whatever encryption protocol file sharers settle upon is likely to be discouraged by isps.
    Remember to be truly effective encryption has to be end to end like ssl.
    Still the fightback by the publishing monopolies is eventually going to be all in vain. They are trying to sustain an outmoded and inefficient trading model. They must realise this and be just trying to squeeze as much out before it bellies up and leaves them scrambling for a new lisense to print money.
    The thing that pisses me off most is that our taxes are being spent helping these corporations recover what should be a civil debt.
    The corporations shouldn’t be able to call upon law enforcement or customs to maximise their revenue. Those agencies should be devoted to primarily protecting life and limb and secondarily individual’s private property. Corporations do not have the obligations of citizens so therefore should not be allowed the privileges of citizens.

    Oh in the future on the VM thing, I left a few weeks back.

    Highly recommend everybody on VM calls the police when this happens – it’s a criminal offence of the saw which enables the criminal legal system to go after company directors (like richard branson), punishable with up to 5 years in prison.

    And if the police won’t bite contact the IPCC because this is a criminal matter not a civil one – we’re talking about illegal interception of communications not a data protection one (even though that is a criminal issue too), don’t let the police fob you off else the government will think people find it acceptable and change the law.

    Those companies can accuse you but with no hard evidence they cant sue you. They would first have to get a court order to obtain any ISP records that actually proves that you downloaded the file.

    And with 15,000 cases i doubt they would waste their time with that many individuals.

    Its just a scare tactic to make you pay, so dont pay those bastards.

    its all scare tactics, its civil claims – not criminal, and if you have a dynamic ip address like most people have then exactly how are they gonna prove it was you? send them a counter claim for privacy violations for £1million and see what they say. they have no legal authority to get your info without a court order

    Studies have proven that those who download music, buy more music. The music industry has been crying the blues since the cassette tape.

    That aside, the reason I say backfire is not only the costs to the music industry, but also the cost to the judicial system and tax payers money. Which as a result to all the lawsuits may influence changes to law in favor of the public.

    Also, each individual case would need to be won. How many songs would an individual have needed to share in order to pay for the lawyer fees and paperwork being done behind the scenes, in order to justify a lawsuit?

    In a lot of cases, the users downloading/uploading cannot afford to be slapped with perhaps a +$20,000 fine and would sooner claim bankruptcy and the music cartel still be receiving nothing in the end. It’s because of this that they’re making an easy way out to just pay the set “affordable” fees and make an easy profit. Note: I’m assuming it’s not £300 to £500 per file, otherwise this will in fact backfire with the many bankruptcy cases soon to come.

    One other note: This will only cause “pirates” to look and find better alternatives such as server downloads like RS, MU, etc.

    When my band records our first EP, you can sure I’m going to release it on the net myself.

    It doesn’t have anything to do with me, but I wouldn’t care if I received a letter from the court of whatever. Ignore it is my policy. What’s going to happen, nothing. Who cares. And the people who commit suicide because they owe money 100k to banks, why? Just ignore it all, that’s what I do. If you have seen the move Office Space where the guy has just been hypnotized, then that is me! And yes, I have received letters asked for debts but I don’t care. I do not have anything in the world, so I do not care about anything. BOOH YA!

    Do they analyze RapidShare files and downloading sites similar to RS? Files have been removed from circulation once uploaded, but do they take it a step further and subpoena or obtain a warrant for the ip addresses used to download that once uploaded file?

Now the shoe is on the other foot isnt it?     Nonsense.. Interpol has nothing to do with whether or not someone can be pursued for copyright infringement.
    If that WERE the case, then how come there is no record of anyone in Iran or Iraq being pursued for copyright infringement (and a lot of them of course do it just as much if not more than there western counterparts). Because its a load of crap. Whether or not someone is pursued is based on the legal system and constitution of the country that they’re in.

    How is this not extortion\blackmail? Pay or we’ll sue you, that sounds like blackmail to me.

    Is it ISP’s that are giving out information or are they simply finding it on torrents? I have a lot of questions about this. I like how they use their strong arm tactics with a thin veil of legality, “settle out of court and we will forget all about it” sounds extremely shady to me.

    I wouldn’t be surprised to see these people file suits against the ones sending the letters I don’t believe this would be accepted in any country with even a half decent legal system.

    If this is acceptable Then there is nothing stopping people from going into business sending millions of letters to people in the UK with some sort of half legal mumbo jumbo demanding money or they’ll sue. Seriously this is ridiculous if you think about it, it just plain and simple doesn’t make sense.

    alot of these letters were sent out to virgin and bt customers last year and the advice given was to simply ignore it and as of today not one case that has been taken to court they have won ( was only one that made it and a oap couple were cleared of uploading porn ) lol

    Scare tactics for them people happy to part with their money

    the facts for the UK –
    ISPS have been liable to log IP Adresses for years , yes , even dynamic ones .
    if you use a torrent , you expose your IP Adress like a street light – it doesnt matter if you use encrytion at all , you will be seen . If you`re stupid and arrogant to believe you`d never get caught , then you deserve to get caught .
    If you use USENET , all the servers from where the file is originally held log all IP adresses .
    But this will be going for easy meat I would say – torrent users .

    I live in the UK and this is nothing new at all, its just more “public” eye now… I once got a letter from BT saying i had downloaded such and such a PSP game, they had dates, times, filenames, and download sizes.

    You can imagine the shock when it dropped through the door.

    now i never use public torrent sites EVER… when mirc was big i used that, then i switched to pay torrents, and members only.

    IF virgin do analyse their packets then people will simply have to use encryption on the files to get around it.

    Don’t worry, they’re only gonna go after dumb noobs who use torrents on unprotected systems and upload like idi0ts! Use RS, MU or any of the online storage servers, they have absolutely no right to touch you, especially if you hold premium (paid) accounts. This is because online storage companies have the responsibility to remove copyright material (on request). If you pay for an account and the file is there, you have the right to download it until it’s removed, hence why RS etc files vanish. Screw the big, money grabbing fat-cat suits.

    I got a letter from my ISP that one movie company had sent them a note saying that my IP was download a movie that was protected by copyright. And they sent me the information the company sent them. My IP, the filename and the download that i have done. Funny side was that i didn´t downloaded that movie. So i got to my ISP and asked them to show me that my IP was that one. They checked and confirmed that i had that IP on that date… but there was a small mistake. The movie company sent the date on the american side… so the month/day was changed. My ISP offered me 2 months of free internet for the time i lost due to there failure. And where ready to help me against the movie company since they had already sent them the information about the user since a french court had already made the ISP to give the information about the users without the need for a court liability.
    Some months after i got a letter from a lawyer asking for 2680 euros (around 4000 dolars) for downloading the movie. I replied that i was ready to go to court because they had shared the movie and i had the information that the file was on that company computers (i had the informations that where sent to my ISP). So i was waiting for them to take me to court. They never answered back.
    So even that you get a letter, never leave it without answer. Ask always for informations on where did you downloaded the file and the size. Many of those things where shared by some companies that are together with those movie and music industry.
    The stupid side is that many of those companies sell recordable cds and dvds. And they sell it on big retail shops in cakes of 100 pieces. Do they thing that anyone is taping 90000 hours of home movies?

    Peer guardian and other ip softwares, new ips always pop up, it wont catch everything. Even if there were local rogue users reporting ips as well, they would get paid for it.

    How come no one does this, when sharing a file, just winrar(or password it) and LABEL it as something else like if it was a “MAJOR MOVIE” like it as 123.txt while another website logs the real files names in forum or site format? MOst torrent sites, file names are REALLLY OBVIOUS, no wonder why people get caught, Companies only have to TYPE IT INTO Google and find the torrent, if it was labled “FUK JOO cam123″ it wouldnt be searchable?

    Since everything is scene related, I would think they would hate it since their name doesnt appear on it.

    It’s just more scare tactics. They’ve threatened this before and it does act as a deterrant for many people who then stop downloading for fear of getting caught, but we all know a court case would cost them a lot of money and if they’re targeting home users, there’s little chance they’ll make that money back.
