Woman fined £16,000 for illegally downloading a game

I actually just read about this, thought it was funny, all for a damn pinball game(which I grabbed for the Wii, not even that fun)

*Edit* I just copied/pasted from a news website. But I hear it was for sharing the game, not downloading. But, how did she get the game in the first place? Was it hers? Also, the first paragraph is a separate story, but sort of linked together, so I posted a bit on each.

Computer game firms have declared war on illegal downloads demanding money from thousands of families who got releases on the internet for nothing.
Top games developers, including those behind The Lord of the Rings, are serving notices on 25,000 people across the UK telling them to pay £300 to settle out of court. If they refuse they risk being taken to court with plans to target the first legal actions against 500 people who ignore their letters. The action is being taken by five companies: Atari, TopWare Interactive, Reality Pump, Techland and Codemasters. They are responsible for top games, which as well as Lord of the Rings also includes the Colin McRae Rally series and Operation Flashpoint. The group have appointed law firm Davenport Lyons to force through the action, as estimates say six million engage in file sharing illegally.
This latest move is part of a wider offensive by companies to protect their copyright on the internet, which has seen the music industry also trying to tackle it. Earlier this week Isabella Barwinska, who at the time lived in Leytonstone, east London, was the first offender to be made to pay damages to a manufacturer of computer games.

She was made to pay £16,000 after being taken to court by computer game manufacturers TopWare Interactive, who were seeking to protect their copyright. A British woman has been ordered to pay US game developer Topware Interactive £16,000 after illegally downloading one of its PC games Dream Pinball. Some experts are now warning the floodgates could be opening for other game (as well as music and film) companies to try to claim money from illegal file-sharers. As reported by MCV, the Patents County Court in London ordered the woman to pay damages of more than £6,000 and costs and reimbursements of £10,000 to Topware Interactive for downloading the game.

“We haven’t played Dream Pinball, but we’re guessing it probably isn’t worth spending that much on.” ———lmfao

I like the whole 300 squids business because it’s a fair warning that seems to not have anything to do with j3w companies trying to have people executed for stealing a song or game. As a thief, I think it’s a fair deterrent and I’m in favour of it. If I copped a £300 fine, I’d throw the towel in (pirating, not life’s towel).

actually-you have this story wrong-she was fined for sharing the game on p2p,not for downloading it-the fine is totally stupid but the facts are not as reported in your article-this story has been on all main uk news channels and she was fined for sharing,NOT downloading.

what you do is when you get caught, destroy your whole HDD somehow, and call a friend to run out and buy the game for them.
then you could say that there was no proof and you have the legal copy.
but couldnt somebody say that they ripped it from a friend?
From the tings i read in the US was that its legal to back up stuff and give it to friends for free, its only illegal if you distribute them and charge them.

    Everyone downloads games/movies/music these days
    ———————–

I’m actually surprised by the number of people who DON’T pirate. I can’t figure it out actually. I don’t listen to music much these days, but I see all that stuff on the shelves and shake my head. I was at a friend’s the other day setting him up with a game. As I was copying the crack over for him he said “I’d rather just pay for it than go through all that”. He really said “all that” about copying a crack. He’s got a good PC and has no idea how to use it. Needless to say I never need worry about having to load discs, which makes it even easier, not harder.

    I never did understand people.

I was at my family’s last month and my Mom said “If the feds ever saw all the movies and stuff you have, blah blah blah”. My brother defended me, “it’s not like he’s out there selling the things”. My Mom then says “that doesn’t matter to them at all”. I then decided” so you’re saying I should sell pirated movies at work?” and then she got mad and hit us.

Once again I direct peeps to the revelations contained in the Wikileaks post about the ongoing ACTA negotiations. If anyone out there can be bothered to stop abusing each other and paying attention, they are at:
    http://wikileaks.cx/wiki/ACTA_negotiations_brief_on_Border_Measures_and_Civil_Enforcement_2008

The July edition of New Scientist also has an article on this.
The internet is going to be subjected to governmental control and few peeps are ever going to have a say in how it is controlled because the method of adoption is by way of a treaty rather than legislation. Any country that wants a trading agreement with another country registered through the World Trade Organisation (WTO), about the only way these largely commercial treaties can be legally enforced, will be instructed to sign up to ACTA if they want to WTO register the agreement.
That covers just about every country.
I’m not going to list all the draconian powers this agreement gives copyright holders; they are too many and the overwhelming risk is that some fool/troll in here will sidetrack any discussion with silly argument over some little piece of this comprehensive attack on internet freedom and freedom of speech. Incidentally those amerikans who imagine they will be able to stop this by invoking ‘constitutional rights’ should think again. amerikan courts have always tended to favour comercial issues over the Bill of Rights and by making this a part of an international trade treaty the architects have got the courts past halfway there.

if you’re still afraid you can of course always go back to buying your stuff =)

Dream Pinball costs £26 . Should of just brought it in hindsight lol. For those that seem to think you cant be found come on be realistic. If “they” WANT to seek you out they will and are more than able to do so. If they can track the original sender of spam down across the globe from country to country and monitor extremists emails and track peadophiles down on a global scale it would be a walk in the park. Chuck into the mix the amount of money companies pushing the crack down have of course they can hunt you down. Its the big fish they wanna fry first. Sadly though now and again they make an example of someone. It cost money and time to do so and marketing companies know its not the answer to the problem to go after your core market. So they hope it will deter us .. mmm dont think so ,Whats that saying.. Dont hate the player ,,hate the game ;) lol

    http://wikileaks.cx/wiki/Proposed_US_ACTA_multi-lateral_intellectual_property_trade_agreement_(2007)

sorry bout that but if you care at all that this net control now gives nations the power to tell other nations what they can and can’t have on their web servers, because the content is ‘illegal’ in their contry, you should care about this. these controls won’t just stop so-called piracy they will be used to control speech on anything a government may choose.
It won’t be a sudden overnight change; the control will be incremental creeping up on us until all the advantages an individual got from the net have been negated but alla the hassles – spam, corporations sharing data about you etc., will remain.

Doesn’t anyone find it odd that the majority of people being charged with illegal downloads seem to be of the type that only download a simple game or a few songs here and there. Seems to me that the so called authorities are targeting the people curious about the net and what it has to offer and not the the hard core downloading like most here. Much easier to control the uninformed sheep then the more brazen and aware.

No they are actually doing this for torrents as well. It is done from a company based in Switzerland who then send on the ips to a legal company then attempt to extort money out of people.

And no you don’t even have to upload 1000 copies they just scan the ips from the tracker and see who is connectible. It’s a big pile of steaming crap.

The best thing to do is blacklist all swis ips using peerguardian or the like.

I read al of your comments till Number 66 (even the spam ones). Think of it guis, if they wanted to end up all this Piracy Staff, they would have done it when it started, but they didn’t cause they’re afraid of people. You can sue 50-100 People, but you cannot sue a Planet. It’s Equilibrium. And i also think that the sued women is just a fictive person and it was invented by them to scare us, maybe she’s the head of the Plan, you never know. Only thing i know, piracy will never stop, as long as they will try… Look at it, last summer they caught RELOADED and some other well known PC Games Release Groups. How come there still are RELOADED releases today, with every new PC Game? they got picked up by the Feds and CIA staff not by local authorities, and they’re still out there on the streets releasing the goods. I think someone is having some interests here… don’t you ?

Seems very harsh considering most of the world and his wife are “illegally” downloading *something*.

So is it P2P and torrents that are being traced?
Does anyone know how difficult it is to pinpoint a download AND a user using newsgroups?

I ask the question because I’ve used newsgroups before now to restore my music collection (damaged media etc.)

I got pissed off with having 500+ CDs knocking around my PC and decided to give them away, then downloaded exactly the bits of my collection to have it all on my HD, simply because its so much easier.
I’m considering doing the same to my DVD collection, I’m now wondering about the legality of this…

*snort* @52, what are you drinking as I want some of this. Lets destroy your argument one step at a time

The internet is going to be subjected to governmental control and few peeps are ever going to have a say in how it is controlled because the method of adoption is by way of a treaty rather than legislation.

(WRONG! In the US we have a law that is written in stone, NO treaty can superceed US law no matter WHAT it says! So it makes no difference what treaty is signed, if it violates US law, then it cannot be enforced. And as for the Government controling the internet…maybe in YOUR country, but in the US there are extremely few laws that deal with the internet…and even these are hard to prove. Take for instance the lady that sued the RIAA and WON! Here we are innocent until proven guilty, you are probably used to being guilty until proven innocent.)

Any country that wants a trading agreement with another country registered through the World Trade Organisation (WTO), about the only way these largely commercial treaties can be legally enforced, will be instructed to sign up to ACTA if they want to WTO register the agreement.

(WRONG! The US has nailed China and India and a few countries in Japan for stealing our tech and not paying royalies for it and the US did it in the WC, and even while a member of the WTO. The WTO tried this crap with us and our Ambassador told them to get bent, we are not signing and if they dont like it then tough too bad. Then he informed them that no treaty superceeds US law…PERIOD! Shut them up in a heartbeat)

That covers just about every country.

    (see above)

I’m not going to list all the draconian powers this agreement gives copyright holders; they are too many and the overwhelming risk is that some fool/troll in here will sidetrack any discussion with silly argument over some little piece of this comprehensive attack on internet freedom and freedom of speech.

(which is exactly what you are doing now< so what’s your point?)

Incidentally those amerikans who imagine they will be able to stop this by invoking ‘constitutional rights’ should think again. amerikan courts have always tended to favour comercial issues over the Bill of Rights and by making this a part of an international trade treaty the architects have got the courts past halfway there.

(Sorry wrong yet again. If this was the case as you claim, then the 4396 people that have sued the RIAA and won, would not have won. Nor would colleges and Universities have told the RIAA to go blow themselves. And let us not forget the 285 people that posted dvd screeners on the net and they got a slap on the wrist..being banned from receiving screeners, big deal; it is not like you cannot find them on a couple hundred sites if you tried. So do us all a favor and speak of YOUR country’s laws and not of US laws since you clearly have no idea what the bloody heck you are talking about and are only speaking or typing to hear the noises made when you do it.)

    Private trackers my ass.

I ain’t giving my info to no one.

If private trackers seriously become the norm, I’ll just hack into the damn private trackers. That has to be the absolute dumbest approach I’ve yet heard.

Yeah, sign up. Open registration on turning yourself in.

What needs to happen is one of you code monkeys comes up with a web site that automatically moves itself around the net in pieces. A movable site. A site that moves four times a day.

Imagine pirate bay strapped to the back of a supersonic jet, flying around the world internet.

That’s where things are going. Whoever can make that happen… well… that dude or dudette achieves scene superstardom.

Sometimes you gotta see the forest for the trees, people.

    Private trackers, my ass.

She should sue them for making her look like an idiot. Also, she should sue the game company for making her so addicted to their game that she had to steal it. She also should sue the govt. just for the hell of it.

If I got slapped with a piracy lawsuit I would wipe my arse with it. Then find the people suing me and kill them. End of story.

England, you gave away too much to be safe. Now you are prisoners on your foggy isle. While the rest of the world continues to evolve, your citizenry will become like cows in a pasture – mooing about whatever new freedom you’ve lost.

Is it too late for ya? God, I wish not.

A radical approach is the U.S. nuking both Russia and China for allowing their citizens to sell copyright DVD’s and Games on the street.

I too received an official “Warning” letter from Davenport Lyons. I was using UTorrent and dolwnloading the game “two worlds”. But because i was using utorrnt and not a free site fro example i have to upload the file while downloading also to get speed.
So after them getting my address from my ISP they wrote me a letter asking for £300 for downloading and £200 for uploading.
I spoke to local lawyers but they didnt have a cluse on what to do, so i went to they Citizens advice beuro and they advise me to egnore it as they could only take you to small claims court.
Anyway i think i am very lucky here as i was reading in computer active magazine that 4 more ppl got taken to court by Lyons and made to pay £800 fine and its still not final. thay may need to pay damages to game producers.!!!

Mask ip in anyway you can… or move to NZB

Seems funny that the majority if not all those countries wouldn’t be considered developed countries. But when you look at the bottom what do you see??? Hmm. Maybe that’s per capita but it didn’t say.

So is it a case of finding a tracker you can trust ? For instance Demonoid has its inferno tracker, and is a reliable safe as in content etc. Or do we think that if demonoid got busted they could quite easily go thru every account ??
sounds all a bit crazy. I do think its has alot to do with where you download from.

and how the hell do you mask your ip ? on bitcomet u can see it clear as day ..but i loves my bitcomet:) ranked Guru
