Woman fined £16,000 for illegally downloading a game
I actually just read about this, thought it was funny, all for a damn pinball game(which I grabbed for the Wii, not even that fun)
*Edit* I just copied/pasted from a news website. But I hear it was for sharing the game, not downloading. But, how did she get the game in the first place? Was it hers? Also, the first paragraph is a separate story, but sort of linked together, so I posted a bit on each.
Computer game firms have declared war on illegal downloads demanding money from thousands of families who got releases on the internet for nothing.
Top games developers, including those behind The Lord of the Rings, are serving notices on 25,000 people across the UK telling them to pay £300 to settle out of court. If they refuse they risk being taken to court with plans to target the first legal actions against 500 people who ignore their letters. The action is being taken by five companies: Atari, TopWare Interactive, Reality Pump, Techland and Codemasters. They are responsible for top games, which as well as Lord of the Rings also includes the Colin McRae Rally series and Operation Flashpoint. The group have appointed law firm Davenport Lyons to force through the action, as estimates say six million engage in file sharing illegally.
This latest move is part of a wider offensive by companies to protect their copyright on the internet, which has seen the music industry also trying to tackle it. Earlier this week Isabella Barwinska, who at the time lived in Leytonstone, east London, was the first offender to be made to pay damages to a manufacturer of computer games.
She was made to pay £16,000 after being taken to court by computer game manufacturers TopWare Interactive, who were seeking to protect their copyright. A British woman has been ordered to pay US game developer Topware Interactive £16,000 after illegally downloading one of its PC games Dream Pinball. Some experts are now warning the floodgates could be opening for other game (as well as music and film) companies to try to claim money from illegal file-sharers. As reported by MCV, the Patents County Court in London ordered the woman to pay damages of more than £6,000 and costs and reimbursements of £10,000 to Topware Interactive for downloading the game.

I like the whole 300 squids business because it’s a fair warning that seems to not have anything to do with j3w companies trying to have people executed for stealing a song or game. As a thief, I think it’s a fair deterrent and I’m in favour of it. If I copped a £300 fine, I’d throw the towel in (pirating, not life’s towel).

actually-you have this story wrong-she was fined for sharing the game on p2p,not for downloading it-the fine is totally stupid but the facts are not as reported in your article-this story has been on all main uk news channels and she was fined for sharing,NOT downloading.

From the tings i read in the US was that its legal to back up stuff and give it to friends for free, its only illegal if you distribute them and charge them.

I’m actually surprised by the number of people who DON’T pirate. I can’t figure it out actually. I don’t listen to music much these days, but I see all that stuff on the shelves and shake my head. I was at a friend’s the other day setting him up with a game. As I was copying the crack over for him he said “I’d rather just pay for it than go through all that”. He really said “all that” about copying a crack. He’s got a good PC and has no idea how to use it. Needless to say I never need worry about having to load discs, which makes it even easier, not harder.

THis story changes depending where you read it. Some sites say she uploaded it and made it available and greedy US games company are making an expample of her. Other say the single mother who is unemployed uploaded it and made it available to everyone. Doesn’t anyone find it odd that the majority of people being charged with illegal downloads seem to be of the type that only download a simple game or a few songs here and there. Seems to me that the so called authorities are targeting the people curious about the net and what it has to offer and not the the hard core downloading like most here. Much easier to control the uninformed sheep then the more brazen and aware.
No they are actually doing this for torrents as well. It is done from a company based in Switzerland who then send on the ips to a legal company then attempt to extort money out of people.
And no you don’t even have to upload 1000 copies they just scan the ips from the tracker and see who is connectible. It’s a big pile of steaming crap.
The best thing to do is blacklist all swis ips using peerguardian or the like.

Think of it guis, if they wanted to end up all this Piracy Staff, they would have done it when it started, but they didn’t cause they’re afraid of people. Does anyone know how difficult it is to pinpoint a download AND a user using newsgroups?
I ask the question because I’ve used newsgroups before now to restore my music collection (damaged media etc.)
I got pissed off with having 500+ CDs knocking around my PC and decided to give them away, then downloaded exactly the bits of my collection to have it all on my HD, simply because its so much easier.
I’m considering doing the same to my DVD collection, I’m now wondering about the legality of this…

(WRONG! In the US we have a law that is written in stone, NO treaty can superceed US law no matter WHAT it says! So it makes no difference what treaty is signed, if it violates US law, then it cannot be enforced. And as for the Government controling the internet…maybe in YOUR country, but in the US there are extremely few laws that deal with the internet…and even these are hard to prove. Take for instance the lady that sued the RIAA and WON! Here we are innocent until proven guilty, you are probably used to being guilty until proven innocent.)

My mate got a letter from Codemasters solictor’s last December they tracked his ip on Bit Comet downloading Colin McRae Dirt for 360. he had to pay £500 or they would take him to court!
The whole thing really shook him up!

I too received an official “Warning” letter from Davenport Lyons. I was using UTorrent and dolwnloading the game “two worlds”. But because i was using utorrnt and not a free site fro example i have to upload the file while downloading also to get speed.
So after them getting my address from my ISP they wrote me a letter asking for £300 for downloading and £200 for uploading.
I spoke to local lawyers but they didnt have a cluse on what to do, so i went to they Citizens advice beuro and they advise me to egnore it as they could only take you to small claims court.
Anyway i think i am very lucky here as i was reading in computer active magazine that 4 more ppl got taken to court by Lyons and made to pay £800 fine and its still not final. thay may need to pay damages to game producers.!!!

If you live in the UK, are a P2P user and your ISP is one of those “Big 6″ that has been in the news recently, I suggest you switch providers, otherwise expect warning letters and/or fines.
The fact that she got caught tells us that she is a n00b (aka typical computer user) when it comes to p2p safety. its not her fault, she was probably too busy being a dumb woman. Let me guess what her computer is like:
*factory standard Acer/Dell/HP etc.
*Norton or McAfee security (cos they always come with standard computers) probably past the free 1 year subscription.
*p2p program either Limewire or KaZaA, autorun at startup (cos shes dumb)
*no p2p security (cos she’s dumb)
*shared folder full of top 40 hits (cos she has no taste in music and she’s dumb) and a pinball game
*Full of spyware/adware.
I read that the pinball game has sold 800 copies but was downloaded at least 12,000 times. Sounds like an awesome game, anybody have a torrent?

So is it a case of finding a tracker you can trust ? For instance Demonoid has its inferno tracker, and is a reliable safe as in content etc. Or do we think that if demonoid got busted they could quite easily go thru every account ??

Why do companies like sky and virgin media give you a monthly allowance if they dont expect you to upload/download??
I get 40gb per month and stick to just under that so surely the companies should get a percentage off the companies like sky for this not the customer. we get an allowance so we should be able to use it how we want. We get the option on phone tariffs with free minutes or texts so why not with downloading etc.

I honestly don’t know if this news is real or fake. What I do know is that I live in a country where most new PC titles come out late (in most of the cases the delay is about 1-2 months) or never. There are a few exceptions. For example Bioshock was available in 28.08.2007. One new title costs around 50 euros. Shops and distributors never lower the prices. For example I saw a copy of Bloodrayne festering on the shelf with a price of 45 euros.Lower prices are achieved when a game is launched very late, like 6-8 month late, and still then price is way higher than the actual prices from Amazon.co.UK for example. Lowest price I could find for Splinter Cell Double Agent in my country is 40 Euros. Sometimes the delays are caused because of some atrocious form of localization (usually the printed manual and the cover). Anyway my monthly wage is about 900 euros, and it’s pretty decent for my country. From those money I have to pay bills, buy food and so on. Basically I cannot afford to buy more than let’s say 4 new titles a month, and even that with difficulties. I tried to buy online. The price + shipment don’t come near the price of the games on the shelves. But they don’t send games to my country. Of course some online shops send to games to my country but in my opinion are not trustworthy. PC games seem to be a luxury in my country. I mean I don’t understand. A person from UK with a monthly wage about 3-4 times higher, has to pay for Splinter Cell Double Agent around 6-8 Euros and I have to pay for the same thing 40 euros. Yeah I almost forgot, I tried buying digital versions, but they only accept PayPal and PayPal sucks (Had some bad experiences while trying to buy from a US online store…) So there seems to be only 2 solutions…Get pirated versions or forget the whole thing.
At least we know she wasn’t a leecher lol
She should go get her lawyer and sue the company for making a sh*t game.
