US scener jailed for 30 months


A bad news came today from American Department of Justice: A US man has been jailed for 30 months for copyright infringement over his involvement in the warez scene. David M. Fish, 26, of Woodbury, Connecticut, was further sentenced to three years on probation this week after he pleaded guilty to criminal copyright infringement and circumvention offences. The computer equipment used by Fish to commit the offences was forfeited. Fish served as the site operator as well as a scripter, equipment supplier, broker and encoder for warez sites between January 2003 and July 2005, according to court papers. His work involved circumventing copyright controls on DVDs and uploading content.

In the Southern District of Iowa case, Fish participated in a separate warez site from Jan. 21, 2003, through April 21, 2004. The warez server used in this case was determined to contain approximately 13,000 pirated software titles including movies, games, utility software and music. Transfer logs confirm that defendant Fish assisted in the uploading of 131 software titles and downloading 373 software titles to and from the warez FTP server.

The case is part of Operation Copycat, an investigation by the FBI and the US Attorney’s Office targeting online warez groups that illegally distribute newly-released movies, games, software and music online. Operation Copycat has resulted in 40 convictions thus far as part of a larger federal crackdown against the illegal distribution of copyrighted materials, known as Operation Site Down. Affected groups included such names as MYTH, Centropy, HOODLUM, VENGEANCE or Corrupt.

    1 out of millions surely means nothing but some of us will consider doing “scene” releases next time after reading these kind of articles so in the long run it will stop majority from doing illegal stuff.

    I don’t think software developers really want or need all warez scene to be shut down but be less spearing to the masses. Still warez “scene” is the most important reason why ppl use such software, if not warez i would never use some Adobe stuff or consider buying it. Large companies know that and small companies user warez releases to spread their software to gain market recognition in not time.

    So again, digital media would be nothing without warez but common sense says some shall fight it to control the flow, if you know what i mean.

    It’s ridiculous that he was charged with “circumvention”. A decade ago, software to circumvent the protection on games was sold openly, as were “video stablizers” to filter out Macrovision on video tapes.

    I dont think sceners will stand down, USA isn’t king of the world, however we can clearly see day by day, that USA want to become the king of the world.

    If sceners do get scared, then i would most likely see just less sceners in USA but more in outside of USA…. in places where USA cannot touch them. Look at piratebay for example, MPAA is already being PAWNED by them….

    MPAA needs to learn, even if you take out a few, there is still the rest of the world to take down.

    MPAA instead of fighting, they should just surrender and make an agreement with the warez community… As simple as that.

    I remember awhile back…. some independent film company was thanking Warez and of course Releaselog… for distributing their film illegally. It was a not so known film named “The Man from Earth”… This was barely known until the warez community got a hold of it and distributed it. Then in return gave this movie a higher publicity and made their income higher…. This is a good clear example to what CAN happen if the MPAA stops fighting and embrace the FREE advertisements that pirates and alike can do for THEM.

    The argument that warez helps promote movies/appz, therefore they should stop prosecuting warez is flawed. What is not being addressed is the fact that it does not matter how good warez is for a movie/etc., it is up to the companies who make movies to decide how they want to promote it. We can’t say oh hey look we promoted it for you in our own way and we think this is better for you so what we have done is good. We really have no say in the matter because it is illegal. I can’t steal something of yours and then promote it or claim make it better or more famous and then use that as a defense. We are a democratic society so if there was enough support you could change the law, but until such time it is illegal and we just have to recognize that.

    It clearly states in the report that he “has been jailed for 30 months” just below that it states “he was further sentenced to three years on probation”.These are two different things.You should really let that reading comprehension take full effect before posting premature comments.

    @19 Downloading any form of media off the internet is not a sin as recognized as stealing in the bible but I agree that it is totally illegal. If I was to break into someones home and steal there dvds then that would be a sin and I would be stealing.

    The people who put david and these guys behind bars are corrupt scum regardless of how much copyright infringement they broke. A guy in Australia shot and killed a 19 year old for a $100 drug debt said it was an accident and got 2 years- the justice system is pretty ****** up over here too

    Uploading is a crime. Upload and go to jail.

    Downloading is a crime. Download and get sued for your retirement fund.
    Everyone knows the risks, but we do it anyway, to save $ and time

    I’ll continue. This doesn’t deter me… I’ll just get a little more secure each time. The thought police are wasting their time… you can’t stop a worlwide revolution. :)

    I’m sorry Fish is doing time for sharing with others, especially if his ethos was sharing and not getting paid. I wish him the best. As stated here… he won’t do the full jail time… they just wanted a severe statement for the press… he’ll do 1 if he’s unlucky.

    Seriously, if this scares off any Sceners, or makes them think twice… I think they should step out now… if you’re that unaware of the risks or unknowledgable in how to protect yourself from discovery!

    My dad works in the movie industry and I know hard it is for him to get his movies financed due to piracy. I hate to see him like this and its piracy´s fault! You guys think its OK, but its affecting the “litte man” in the streets. OK, let´s see how long it will last, if you say piracy will be around forever, in 10 years you´ll probably still be trading movies from 2008 since the movie industry will stop making movies if this continues!     I feel bad for those people down the line who don’t get paid well enough in the movie industry or for the showbiz industry as a whole but those big companies, actors or singers care enough? I dont think so. They all say that they do or such balonies but do they really mean it or just plain grandstanding? If they do they should take a price cut for their services and spread the wealth to everyone who contributed to the success of their projects. but no they’re too greedy to do that. they all want the money to themselves to get fatter and richer and then just do what they are good at best. that is act like they care.

    Well lets take this from the top, the line than Piracy is having a negative effect on the movie industry, is a load most likely. Studies have shown, in the music industry at least, that piracy has -actually- =increased= sales rather than decrease them, due to the amount of people that can actually listen to something first and decide they want to shell out the rediculous amount of cash that a CD costs. That study was posted about right here on RLSlog a while back, as well as TorrentFreak. IF MPAA-Fan is telling the truth about his father line of work, then someone has lied to him and his father, and filled them chock full of Mpaa propoghanda. Although the idea that the Mpaa would bother telling movie makers, “We won’t finance your movie due to piracy” doesn’t make much sense even for them. Perhaps financial backers do not like his movies, and are using that as an excuse not to just tell the man, “Hey, your movies suck.” Again, that is purely one possibility.

    Moving on, while I do not follow “God”, by that particular name, the concept of right and wrong is not so clear cut as it is being made to sound like. Is what we are doing wrong? Legally, to the eyes of those currently in power, yes. Morally? The answer is not so simple. The MPAA/RIAA/etc would have us believe that we are stealing, so that would make it morally wrong, yes. However, the artists who have chosen to release themselves online, without the RIAA involved, have commented that piracy really has not affected them, and they make MORE without the RIAA involved. Which is to say, we are NOT taking ‘food from the artists families’ as they attempt to lead us to believe. We are NOT ‘robbing from filmmakers’. We are taking money from the people who are setting the prices astronomically high. We are taking money from the people who are busy ripping off filmmakers and recording artists. The RIAA and MPAA want to nail pirates because we are taking money from THEM, not the artists and filmmakers.

    Note: Actual Record Sales account for less than 2% of an artists profit. Most of their money is made in merchandising.

    If piracy destroyed the ‘industry,’ people would not stop making music. People would not stop making films. The cost involved in making both would go down without the RIAA/MPAA. Quite simply, on the off chance that these groups were ‘taken out’ by piracy, creativity would still happen, and everything from making a movie or album, to buying it at the store, would be cheaper.

    You didn’t really think it costs labels $20 per CD to produce it did you? CD’s are cheap to make, and that money goes to the labels, not the artist.

    Now when you look at it that way, suddenly what we’re doing doesn’t look so MORALLY wrong anymore. It looks more like we are against the MPAA/RIAA, but FOR the filmmakers and recording artists.

    @89 & 90 thanks, I´ll discuss this stuff more with my dad. I don´t think his movies suck, he´s trying to make his first feature, but they´re mostly telling him that nobody will pay for his “small” film and that they can´t make money on it because people will rip it straight when it comes to DVD. I´ll support my dad and others (like his friends) by buying their DVDs instead of downloading them so they can make more movies. They love their work and I think we all should support them!

    If he is a smaller filmmaker, I recommend you look back through the TorrentFreak or RLSlog posts. On at least 2 occasions, smaller filmmakers have actually thanked piracy for getting their film more widespread recognition than would have been possible otherwise, which put them in a better position for their next film.

    It’s that the MPAA won’t make any money from him. That’s why they are telling him that. Your dad will probably make more money on his own, especially with file-sharing to make the movie more popular and recognizable. It’s the MPAA that you and your dad should be against. They are the one’s taking money from all the film makers and making it look like it’s piracy’s fault.

    And btw 30 months is rediculous for a non violent crime of simple piracy with absolutely no money involved (i mean he did it for free) cmon its no like he killed some1 for God’s sake

    Whoever told your dad that people will rip it straight when it comes to DVD was talking bullcrap, it will actually help your dad and his friends if it gets distributed on the scene if the movie IS good, then be asured ppl WILL buy the DVD and money WILL come out of it, real talent wont be wasted. On the other hand if the movie really is bad then it will probably backfire and if words gets around that its a bad movie then obviously sales will go down, but either way its for the better IMO.
