UK: tougher piracy laws, blacklists of pirates

Six of the UK’s biggest net providers have agreed a plan with the music industry to tackle piracy online. The deal, negotiated by the government, will see hundreds of thousands of letters sent to net users suspected of illegally sharing music. Hard core file-sharers could see their broadband connections slowed, under measures proposed by the UK government. BT, Virgin, Orange, Tiscali, BSkyB and Carphone Warehouse have all signed up. Geoff Taylor, chief executive of the BPI, which represents the music industry, said: “All of the major ISPs in the UK now recognise they have a responsibility to deal with illegal file-sharers on their networks.” The plan commits the firms to working towards a “significant reduction” in the illegal sharing of music.

In addition to this chance, parents whose children download music and films illegally will be blacklisted and have their internet access curbed under government reforms to fight online piracy. Households that ignore warnings will be subjected to online surveillance and their internet speeds will be reduced, making it very difficult for them to download large files. The measures, the first of their kind in the world, will be announced today by Baroness Vadera, who brokered the deal between internet service providers and Ofcom, the telecoms body. About 6.5 million Britons are thought to have downloaded music illegally last year. It has been estimated that illegal downloads will cost the music industry alone £1 billion over the next five years.

    Back in the day, I would spend $80 a month on Cds.. Now I spend $50 on my cable ISP and $30 on usenet. So, somebody’s making money, aren’t they? I don’t hear the new guys complaining, but the old guys sure are making a fuss, aren’t they?

    Shut down the internet, it will just push us back to the street fairs. I kinda miss the old ‘copy party’ days.. anyone here remember those?

    At least you can fight back if using usenet, most ports for the servers are secure HTML anyway, just claim you use the connection for work related things, watch them squirm then tell them where they get off mentioning how many other providers are out there.

    With the SSL in place you “should” be untracable anyway, wish we could say the same for torrents though. Me I am just happy for being with AOL for once…

    @ 200 i agree.

    The fact that I use rapidshare and stuff to download and not P2P the ports and packets are different, considering I only download about 20 films a month max, mostly on average about 10 I don’t have anything to worry about for these reasons:

    1. Don’t really care, send me a letter i’ll go cryface later.

    2. My ISP isn’t on the list (bethere.co.uk) and they’ve said on their community forums that they will not join in with it either.

    3. My ISP has no limits, Be Unlimited (yea we all know the unlimited is bolex) but they actually don’t care, I haven’t seen one person complain about Be reducing their speeds (intentionally) or warning them about their download amounts.

    All in all I think I made a pretty smart switch from Virgin to Be last month, for one I get a constant speed now instead of 2200 KBPS/sec on minute and then 500kbps the next, now I just get a constant 2000kbps flow.

    Nuff said. :D

    Meh, I hacked my Virgin modem to a true 20mb connection, been running it for a long time now. Funny thing is I am not even a Virgin subscriber, so good look sending me letters. If I get caught, just switch MAC address, easy.

    The best Isp in Britain is Fast.co.uk, they charge a bit more than other ISPs,and I have a 40gb download limit, but trust me it beats the crap out of the main Isps like Virgin etc.

    It’s not new laws, it’s actually optional - I’m pretty sure it’s not the first deal of it’s kind, I’ve read about such things before. (iirc)

    YES tiscali ARE ALLREADY DOING THIS AND HAVE BEEN SINCE LAST YEAR BANDWIDTH SHAPING AND PORTBLOCKING ME ! they have accused the p2p users as pirates well they have overlooked dilebirately that GAMERS use p2p and block them from playing games such as trackmania and enemy territory quake wars and the soon to be released game battlefield heroes. I dont call that fair usage not being able to play games when i have spent my hard earned money on and i pay for the privalage of being phuked over like this

    The main reason ISPs throttle is not because of piracy, I doubt Virgin or any other ISP deep down give a toss about piracy. Its simply because their networks cannot cope with increasing numbers of people using loads of bandwith, due to stuff like BBC’s Iplayer and other bandwith hungry services. So instead of investing in their networks, they take the easy way out.

    The internet is going to be unrecognisable in a few years time, especially if the governments of the world have their way in monitoring all internet traffic, emails and phone calls (The British government have discussed this already), apparently to protect us from those pesky terrorists, or the go for the emotional argument “pedophiles”, everybody hates those guys. If anything we need protecting from our governments, (yeah I read 1984 like 10 times as kid, it affected me lol)

    Just for the record, i recieved a letter from solicitor davenport lyons regarding a game i downloaded in may 2007, with a 30 day dead line to pay a fine of £758,i thought it was a scam so i rang virgin media my isp, and they said they had been issued with a summons to provide names and addresses of the captured ip adress, i did try to argue my case and deny it with a strong letter but all they said was my ip adress had been recorded using software, the moral of the story is even if you use peer to peer gaurdian and private trackers, if a company has enough determination & resources,it will catch you, i was just unlucky, the game in question is TWO WORLDS by reality pump zoo ….my advice .be carful..

    This is a repeat of my earlier question. There seems to be a lot of smart****s out there but no answers.
    Let me get this right. Are the ISPs going to monitor the amount of downloads and chastise me for the amount or actually monitor the files? If its the files, how do they know whats in it if the title is non-specific and the contents are zipped? Put simply, how do they know my download is legal or illegal?

    Firstly I dont think ISPs are sophisticated enough to monitor everyone’s internet useage beyond volume. They cant send out letters purely based on volume either because there are several genuine ways that you could download legal content (paid for downloads, open source software, streaming services etc). So firstly ISPs will need to prove that what you downloaded was illegal.

    Secondly, most ISPs seem to not know their arse from their elbow. I couldnt imaigne them actually being coordinated enough to write a letter let alone send it out to the right person and then manage to administer the account properly!

    “The MOU places joint commitments on the signatories to continue developing consumer education programmes and legal online services. Most importantly, for the first time ISPs will be required to work with music and other rightsholders towards a “significant reduction” in illegal filesharing.

    To achieve this, in the first year hundreds of thousands of informative letters will be sent by participating ISPs to customers whose accounts have been identified by BPI as being used illegally. In addition, under the auspices of Ofcom, the signatories will work together to identify effective mechanisms to deal with repeat offenders.”

    So ultimately this press release seems to be around the fact that ISPs have agreed to send an ‘informative letter’ to ’suspected customers’. Well they’ve got me running for the hills there…

    The thing i dont understand is that utorrent 1.77 which i use
    has it’s own incoming and outgoing encryption,does’nt that help ?????

But jesus christ, you have to have SOME aptitude, otherwise get your newbie questions out of my fuk1n face. You teach them how to download, where to get it, and what to use.. they come back with, duh how do I ‘mount’ this game; how do it unrar this….

    I tell em, hold down ctrl+alt+delete, press shutdown, unplug from wall, chuck out the window.. Or failing that RTFM.

    Simple answer is not to file SHARE

    I simply use a rapidshare premium account. It’s a direct download from one site and it’s fairly secure. Unless rapidshare turn over their server logs (unlikely), there is little else left to implicate me.

    Things like Kazaa and Limewire are worst. You are identified AND you can see what files you are uploading. Most people get into trouble because an anti-p2p agency can download files from you and then present those files as evidence that you are sharing illegally.

    Bit torrent is 2nd worst because no sites are secure. Peerguardian is a complete waste of time but it DOES show you that no matter what tracker you use, there are lots of anti-p2p people there. Oink, waffles, what, supertorrents, demonoid etc… they ALL regularly have anti-p2p people in the bit torrent swarm.

    Again, with bit torrent you are forced into uploading, which again can get you into trouble.

    Newsgroups are probably your best bet if you use an encrypted connection with a site that doesn’t keep logs for very long.

    And finally.. this article isn’t even news. ISPs have *always* written warning letters to people… this is nothing new. They will still write letters to you for excessive bandwidth useage, even if they can’t prove you’re sharing or downloading illegally.

    There is no software!! That is going to help… No matter what you do, no matter where you download it the ISP’s are going to monitor the amount of downloading you do! People who download are going to stand out a mile. All the ISP’s have to do is look at the amount you download and the file size and type of file.. Thats it then your names on the list. The only thing that we can really do is give what ever government a kick in the ass…

    vpn is a solution but not the total solution, an anonymous ip is good but evil eye made the most valid point here, the amount you download is just as important. isps can spot the large volume of data and the specific size of files you are downloading, it’s a dead give away. And as others have said its not in the isps interest to have heavy users. the solutions to this is don’t download crazy large amounts of data, stay under the radar. If someone has a solution for this speak up and you will be known as the messiah. (seedboxes?! i dunno) All you pirates in da uk should switch your isps to one that isn’t one of the big six reported. Even light users should move to other isps. Hopefully this will have a combined affect on the big six isps profits dropping through the floor and hopefully their collusion will end with anti piracy groups. As we are all aware business is about the profit margin. Always use encryption. Investigate other solutions as i am doing such as rapidshare type of accounts, usenet and whatever other solutions are out there.
    Never forget this is a cat & mouse game and the pirates will always win because one the cat is fat, bloated, slow and stupid and secondly one legged pirates are always a couple of hops ahead;)

    im just going to leave my pc on 24/7 for aslong as I can downloading constantly from newsgroups!

    just going to tick every box on newzleech and download just to piss virgin media off.

    They came out with the caps during 4pm-10pm once u exceed 3gb then they said between 12-10pm if your a repeat offender so how can they possible cap us anymore….

    I am currently paying £86 for VIP Package on Virgin which is everything they offer with 20mb broadband which to pay that price I have to work every weekday 8am-5pm so they only time I can use my connection is during the capping times and even then the speeds i get is 587kb/s so basically im paying for a 20mb and getting a 5mb connection.

    Thanks VIRGIN!!

    The truth is from my world, this is a master plan which has been in the pipeline since the internet first found its feet, Governments all over the world do not like free speech and they do not wish for anyone else to broadcast there opinions, about whichever government.
    As long as people realise that Business and Government are so heavily dependant on each other due to both parties looking out for each other…..we the UK population have effectively pirated music for decades…reel to reel…cassette tapes, the internet is just a part of the time link really and the BPI and other associated parties realise this but as a favour to our ever increasingly surveillance hungry governments, they will be the bad guy….what do they have to lose…the UK public won’t boycott the music industry..or the Film industry, Because….we are …and have always been self interested, regardless of what anyone else ever says on this board, this is the truth from my perspective…..So go for it Big Brother!     PeerGuardian is effective. You can make your own .p2b lists to your liking. If you do some research, it is a very useful addition to other techniques. Look into various VPN services available, there’s a great one in NewZealand on offer! To make it even harder for these A holes, Use, VPN, Peerguardian, Forged html headers, and chained proxies. You’d have to be Osama for them to put enough effort in to catch you.

    if you’re on a bt connect and use the vision box they won’t reduce the download speed below 2meg due to bandwidth needed for tv . as for the other dsl isp folk not agreed with the bpi they soon will because i was on a none bt dsl line and hammered it via newsgroups and got a nasty letter saying that they were being charged more from bt for bandwidth usage . just get some old fogey a net connection and download like f**k and when they get hassle say they have dementia :).

    Ok i’m thinking of using VPN but a previous post has said this is illegal and a breach of intimacy laws with Virgin media….what the?Surely not?I don’t download huge amounts of data but do like DVDR 4.36GB when they are out.
    I’d really like to know what the existing virgin media customers like myself are doing to try and sort the buggers out?
