TorrentSpy Blocks Searches From US Visitors

Starting today, TorrentSpy blocks all searches from US visitors and redirects them to a privacy statement. TorrentSpy is caught up in a lawsuit in which the MPAA demands that TorrentSpy hands over all user info stored in “random access memory” (RAM).

This service denial seems to be a preventative measure to protect their users, when US users try to search on TorrentSpy they now get this message:

Sorry, but because you are located in the USA you cannot use the search features of the Torrentspy.com website.Torrentspy’s decision to stop accepting US visitors was NOT compelled by any Court but rather an uncertain legal climate in the US regarding user privacy and an apparent tension between US and European Union privacy laws.

The search redirect will be permanent, TorrentSpy owner Justin Bunnell told TorrentFreak: “We must comply with European Union privacy laws and turning off USA traffic was the only way to guarantee that protection for our users. It is not something with a time limit.”. Over 15% of TorrentSpy’s visitors are US residents, shutting them down for good will be a disaster for the site.

We also asked Justin how he thinks this will affect the future of TorrentSpy, and he responded: “Whatever future awaits, the innovations of peer-to-peer technology and the jobs and opportunities it creates will take place outside of the USA.”

TorrentSpy currently does not log any user data, but if the court decides that they have to hand over all information stored in RAM, this would be a huge blow to Internet privacy. The MPAA reasons that all IPs, downloaded .torrent files, dates and other user info are temporarily stored in RAM for a few milliseconds and demands that TorrentSpy logs this info and hands it over to the MPAA. Basically they are demanding that TorrentSpy should keep server logs (pdf link).

TorrentSpy lawyer Ira Rothken is determined to fight this but said in a statement about the case: “The odds favor the copyright owners, copyright law in this country is Draconian and dramatically skewed on the owner’s side”.

Everything TorrentSpy does also applies to other search engines according to the TorrentSpy defense. Last year, when the case started, Rothken said “It [TorrentSpy] cannot be held ‘tertiary’ liable for visitors’ conduct that occurs away from its web search engine”. TorrentSpy claims it did nothing illegal and suggested the MPAA should sue Google.

    Actaully this started yesterday Pacific Time. I went to search on Torrentspy yesterday and it displayed that according to certain copyright laws between the United States and Europe I couldn’t use torrentspy because I was from the United States.

    should be able to go to torrentspy through one of the many online proxies to continue your search if you’re in the US. I’m in China right now, and whenever I use it to access livejournal or myspace when the Chinese government decides to block those sites, they come up with Dutch or German language. Maybe someone can try it and:

    That’s funny Bob. But it’s to be expected. All the media comes from the USA. So the American companies have the greatest stake. Simple economics. I can’t blame the MPAA for not trying to stop piracy. I pirate. All the time. Everyday. I won’t pay that much to see a movie or eat popcorn. (around $6-14 taking into account for variables). So I download films. But that doesn’t men they are sickos for trying to protect their industry. Now, do I think downloading movies hurts the film industry? No, I think it helps. When I watch a nice movie, I am sure to tell people about it. These people go to the movies, they rent the dvds, they order the ppv. Should the MPAA be paying me for advertising? They are rewarding me with free screenings. The fact that the 2007 summer film season was so successful is testament to my words. Will that stop the MPAA from it’s tatics? No. Do I worry about them? Not in the slightest.

    Good thing i have dual citizenship, i can return to the Netherlands any time i want. It is easier for me to make money here in the US though ;) I suggest that all citizens in the US that can afford it apply for citizenship in another country (even if it is Canada) that way you can leave when the shit hits the fan, if you catch my drift =\

    I hear you loud and clear #7, jdizzle. It was after watching SICKO that I started looking into dual citizenship! Apparently you do not have to ‘give up’ your American citizenship when applying for Canadian, French/European citizenship. But in order to meet the requirements it appears you have to do quite a bit; move, visas, get employment?, or pledge to the queen (or motherland)?!
    I LOVE America but I do not appreciate the way the our system(s) have fallen victim to big business. Money makes the world go ’round but in America it is GOD. We dont know the what direction to take..this country was built on Capitalism but appears it also appears that it may be devoured by it as well. We have it great here, but you gotta make it on your own to reap what we (America) has to offer.
    This blocking of torrent searches was a long time coming. IT is the begining of the war if you ask me. If it wasnt for my asshole country putting pressure on Sweden, Denmark, and others whom enjoy a “free” www, we wouldnt have to sweat everytime we are on a site. Oh, wait, if it wasnt for Corporate America and their endless thirst for capital gains putting pressure on my spineless, corrupt government representatives I also would be able to do what I want online.     An important distinction: the MPAA/RIAA are NOT the United States Government and have nothing to do with it. They are private organizations who grossly abuse the legal system for profit.

    The fact of the matter is when I was in high school I used to “dub cassettes”. The RIAA tried to keep dual cassatte decks of the market for that reason. However, they have a legit use.
    Same with P2P. And BTW, not many people know or talk about this. The RIAA gets a certain percent of income off of blank media per an agreement they arranged. This may date back to blank cassettes. But I understand if you buy a spindle of blank CD’s, they make some money on it. So they are presuming you’re going to copy music. So they are still making money weather or not they sell the artists cd’s. Truth of the matter is I think the last time I like a whole recording was in the late 80’s. I like being able to pick and choose my songs. Maybe if they had a machine in the record stores where you could custom make CD’s more people would be inclined to buy them. Seems like they try to either scare or guilt you into buying their products. I don’t like those tatics. I went to see a concert this summer. (Styx & Def Leppard) The tickets were advertised for $20. Buy the time it was said and done I paid $40 for my ticket (their hidden fee’s). The beers were $10 each. (I drank 4) So I think they still make money. I’m not worried about privacy or human rights in the USA either. Fact is the government keeps tabs on everybody. So what? Always have, always will. I bet all governments do to some degree. I am still doing my thing with no problems. I’m not a gangster. I’m not a someone from the southeat corner of the globe with 100,000 pirated discs to sell. I download a film because it’s nicer to watch it at home.

Basically you have no rights and privacy, especially to the middle eastern people, especially teh first couple years of the 9/11 attacks.     Let’s face it, we all ARE stealing. But I just don’t give a crap!!!

    I download a lot, but I’m not some hypocrite trying to dress it up. I’m don’t believe crock like erok713 writes in post 6 (downloading movies helps the film-industry yadayadayada). Most people that download a movie WON’T watch it in the cinema or buy the DVD, and the same goes for the games, programs, comics and books we can find on P2P. Luckily there are suckers that still BUY stuff, and our economies are strong enough that piracy isn’t a real problem (even if the industry says it is).

    Bottom line is we get lots of stuff for free and we get away with it, unlike somebody who gets caught stealing something small from a store. So what if the MPAA tries to stop this? They have every right to do so. Pirates play a much dirtier game than the MPAA. They hide their crimes behind the “freedoms” we all are lucky to have, but they don’t know what those freedoms are all about. Hypocrites all of them, so why not feed of them?

    Thankfully I don’t care. I have a social concience and a brain, but I can shut them both off. I don’t care if I’m hurting big or small artists, programmers or companies. Let them rot in the gutter is what I say. They can always work behind a conveyer-belt, packing boxes or something. Let the economy suffer, it’s a fake concept anyway. If you want me to buy more stuff, give me more money! But people who do have lots of cash hog it and their only goal is to get even more. This world is sick, so why bother playing along? If you do something, do it for yourself and maybe the ones you care about. All the others? Don’t give a crap!!!

    Thanks to rlslog and all the other torrent sites for providing the stolen goods. Just don’t try to sell it as “a right”.

    Good move on torrentspy’s part, and I truely hope they fight this case to the finish. Sure, blocking 15% of your users, well, maybe 3 percent, do you really think all 15% don’t know how to use a proxy? seriously?

    This ban is a joke, it’s a pathetic joke that really shouldn’t ban anyone in the US as they can merely use a proxy from another country.

    This is why it’s a great idea for torrentspy, looks like the mpaa is winning when infact, they are just as retarded as the idiots that think blocking US traffic means you can’t visit that site for life.

    I think there is a much bigger problem facing torrents in the US than not being able to access a site.

    I just moved from the UK, got my 6Meg connection, then discovered 10 days later that my ISP has a super fancy new anti-torrent software that returns all incoming requests to open connections. This particularly screws Seeding after completion.

    Anyways, after my 3 weeks heres a run down of the 3 biggest retardations here:

    1) Drive up ATM’s

    Get out the car fatties!

    2) Owning a truck when you are not a company.

    99 times in 100 there is no need at all for the space. HIRE (as they say here:RENT) a VAN when you need it.

    3) Mail in rebates.

    Just charge me how much I have to pay first time!

    Other than that lay off the burger bashing, they definitely taste better here! and a 32 Ounce (950ml) Beer definitely hits the spot!

    America is becoming less and less of a free state. Everything is monitored, which isnt that bad if your not doing anything wrong but its still unnerving to know you are being watched or spyed on most of the time. The US was actually seed with Nazi generals years ago in the 40’s. The military, space programs, and government. As far as BUSH goes…he is by far thee worst president the US has ever had in office, no question about it. But hes just a puppet, that spews out what the government tells him.

    Even though it is hipocritical to say its ok to steal music and movies software ect. thats like saying its ok for me to go in your house and steal your 42 in flat screen tv or your favorite pair of pants, cause its not. But it happens every day, some people get caught and some dont. So…dont get caught. The only difference is were all stealing from huge corporate businesses that claim were destroying their business, when in reality they are only losing a small fraction of sales and not really cause most people who download of the internet will never go out and buy a dvd for $22 that costs them 22Cents to make. and others just cant afford to spend gas money to get to and from work all week on a night at the theatre.

    So the RIAA and MPAA are invested in CDs and DVDs, thats just all kinds of wrong. They want to stop us but they invest in what they know we will buy. and then if they do catch someone they try to charge them thousands they never had to spend in the first place!?%# And i agree if they are filing lawsuits against this and that website, they should indefinitly be filing one against the almighty GOOGLE, they offer the same access (if not more) to torrent sites and beyond. I second the RICO act on these cocksuckers!!!

    If the government spent as much time catching Rapists/killers/pedofiles/ect. as they do on copyright infringement the country would be a better and safer place. but you know why they dont? cause theres no money in it. Same as legalizing marijuana, if the government could find a way to control the sales they would legalize it. They legalized acohol, even though more people die from alcohol related accidents then marijuana ever has, why cause it belongs to the government, the government owns and charges hundreds of thousands of $$ for the right to sell liquor(ie liquor licenses)in the US. then tax you federal/state/local then they make you tax the buyer.

    Getting of subject, sorry. Well If this shit really interests people I would like to suggest something to watch. its called “Arsenal of Hypocrisy” type that in google. The US government is interested in not only Global dominance but to dominate space. Like my buddy told me: “Just watch it, it will blow your mind.”

    Lastly, I will say the whole world is goin to hell in a hand basket. The safer you feel in your little cube of space, the less safe the rest of the world is becoming. It may not be for a long time to come for all of us to see, but if this world keeps turning the way it is, maybe our kids grandkids will be talkin about WW3 on their favorite release site.

    Has the US blocked any other sites prior to this?
    I used to cringe when I would discuss China blocking specific sites from their public. The internet should be available and free to roam for all.
    To me, this seems to be a major step to Norht Korean style of gevernment. okay, maybe a little exageration.

    Looks like the ban has been lifted for some reason, perhaps from hundreds of angry emails. Torrentspy used to be a fairly decent site but has slowly declined and is now not even worth using. Anyone using it now after the ban must be insane because chances are your IP is being logged and sent to the MPAA.

    I think the story is that TorrentSpy is blocking the U.S. users to increase publicity for their stand on storing user data. They don’t want to follow a law that will require them store their user’s data for possible use in civil and criminal matters if required by a subpoena.

    The U.S. government is just trying to help a U.S. industry crack down on the theft of its products.
