RLSLOG back online: What really happened
Wow. So we are back online and in full strength again. But it was a long fight. I will disclose few details and what was really going on from my point of view. It’s been a really unusual downtime, considering both its reason and its length. But let’s start from the beginning.

Almost a week ago, we (and many others) received a takedown request from infamous Web Sherrif. The release in question was Franz Ferdinand’s new album Tonight. That itself is a delicate case: Franz Ferdinand is a Scottish band which encouraged piracy few years ago. They specifically mentioned Limewire and other p2p applications and offered few tracks for free. They also said they themselves download illegal stuff from internet. Now, they (or their distributor Domino Records ot be exact) hire Web Sherrif to pursue everyone who would want to share their newest leaked album. Talk about turnaround.
This takedown request from Web Sherrif was a one big joke from the very beginning. As you probably know, we do not host any content on our servers and we do not offer anything for download. Therefore we have nothing to remove. We only inform about new releases and eventually link to third party servers where you can download them (the very same thing Google does and noone cares). Most of the download links is posted by our readers anyway. The quote in the request ("your web-site has published and is digitally distributing“) is therefore completely false. We didn’t publish anything. We just wrote about it.
Another funny thing about the takedown notice was they couldn’t even write our URL properly. They wrote "rslog.net" instead of our proper URL, so I replied to them I don’t own this website. They didn’t get it and stepped up their idocy: "you must also arrange for the following apology to be published on the relevant page of the site for a period of seven (7) days :“RSLOG wishes to apologies to Franz Ferdinand, Domino Records and Web Sheriff for the disruption caused to their sales, marketing and promotion plans by our publishing of pirate file details relating to the unreleased album “Tonight”.”
I couldn’t help myself but reply in a similarly stupid manner: “Thanks for good laugh. once again, learn to type instead of drinking brandy in saloon. Yours Old Shaterhand." This was the very last piece of communication we had with Web Sherrif. I guess they got pissed and realized this won’t really work. So they moved to higher level. They contacted our host, which kindly asked us to remove download links from the article, which we really did (Google Cache). One would think this is the end of the story.
But it wasn’t. Instead, suddenly our website stopped working. It came like a complete surprise with no explanation. Of course, I inquired with our host what’s going on, but they seemed to not really care about replying fast. Their usual response time is circa 24 hours and even more during weekends, which is one of the reasons why I’ve been thinking about moving away from them for a long time – but never actually did it. After a day of struggling, they finally replied: Web Sherrif sent the very same request to their bandwidth provider and they, instead of protecting the rights of their customers or analyzing anything, completely shut down the servers and nullrouted the IPs. Fair enough.
So for the rest of the time, I’ve been trying to find out what to do next and instantly started negotiating with different hosting companies about new servers. Don’t be fooled – RLSLOG is terribly huge and I found out almost no hosting is able to have servers for us ready in acceptable time span. The communication was also very scarce because of the weekend and tens of international calls I made didn’t really help. Day after day continued with no replies and no good news. And then, out of sudden, yesterday shortly before midnight, a miracle email came: “Your servers are online.” No explanation, no details, nothing.
This whole thing taught me a few things. For starters, you can’t believe anyone unless you know him personally and even then things may screw up. Second, hosting companies are scared shitless, slow with replies and don’t really care about their customers, although we didn’t do anything illegal or wrong. Third, it’s always good to have a backup plan (in our case, backup servers ready to host the site in case of something similar happens), because it takes many days before hosting companies set you up with something.
If you take it from the other side, we did our best to get over it. We moved the domain to a temp server to at least inform you what’s going on. We made a private temporary blog and prepared all posts there to have them ready when we get back online. We informed you about new releases at our forums. We mailed Franz Ferdinand and asked them if they are happy now. And we still rock. Thanks everyone who offered me help during the tough time, it was extremely stressful period of time for me. Let’s hope this was the last portion of bad luck in 2009. And let’s hope assholes like Web Sherrif will rot in hell. They deserve it.

Incidentally I actually downloaded the F.F. album in question and quickly dismissed itan hour or so before Rlslog dropped offline. Put bluntly it is crass vacuous pop, and unusual for me (I usually keep at least one copy of everything) I had already deleted it before the fuss started. Perhaps the record company was aware of the particular damage that downloads / viral marketing can do to record sales when the base product is just rubbish to begin with (!)

In order to avoid such a situation in the future, because this won't be the last time this happens, why not just link to a google search for the release? Rather than linking directly to torrent sites? And maybe ban members posting rapidshare links? It's harsh, i know, but at least it might keep the sniper's at bay.

It seems a bit harsh to be overly critical of the hosting company, apart from the lack of communication. They are running a business which attracts more than its fair share of attention from litigators. You *know* that RLSLOG can be considered a hot potato. In that respect you cannot consider yourself to be a 'normal' customer. Whether that is right or wrong is an open question, but it's just how things are.
So, instead of expecting a hosting company to take a moral stand for you and expend their own money (which would also damage the service they offer all their other customers who do not receive this type of attention), you should instead sign on with a hosting company who is aware of and agrees up front to defend the issue. You will most likely not find one, because they are all businesses trying to make some profit from hosting web sites, not legal crusaders trying to fight the copyright fight.
If you genuinely believe that your rights as a customer are being infringed, look through your contract and file a breach notice. Otherwise, prepare to put your money where your mouth is and hire a lawyer to actually win a case in court with regards to the current legal grey area of linking to pirated material.

It's nice to hear people are so supportive.
RLSLog is providing information on pirate releases. Whilst there's currently a legal loophole in that the site doesn't actually host any illegal content, this situation will not last forever.
In the meantime, anti-piracy outfits like WebSheriff just ignore the site owners and go straight to the hosts or bandwith providers. These people are running a business and aren't interested in the technicalities of a legal arguement about hosting vs links. So they just switch off the site. At worst, they lost one customer. So why should they care?
I doubt Franz Ferdinand know anything about this. It's most likely the record company taking this action because the downloads impact on their profits more than on the band's. Chances are, they've got a standing agreement with WebSheriff and they simply provide them with a list of stuff to search for.
Martin behaved fairly well in this, but a lot of this could perhaps have been prevented if he hadn't decided to be funny over the spelling of RSLog (it's not like Martin is the king of grammer and spelling anyway). Clearly WebSheriff didn't understand his point and just moved up the list to hit the host. And it worked. WebSheriff won.
So now RSLog's back with the relevant article deleted. This will happen again. And keep happening until a change in the law regarding what "publishing" is exactly.
Oh and for all those who wish to attack WebSheriff: I really wouldn't. Running a DDOS attack against them is illegal… really illegal. It's not a grey area like links. And no doubt this has happened to WebSheriff before and they have the means to deal with it. And they're certainly prepared to use the law.
If you really want to do something about WebSheriff, why not complain to them directly? They can be found at 2 Queen Caroline St, Hammersmith, London, W6 9DX. It's a suite of offices where they occupy just one. It's run by John Giacobbi. Or why not look up their domain registration and note that their registered address is incorrect (which is in breach of registration rules) and target them that way?
No offence Martin, but if you're going to point out bad spelling and grammer in other people's work, you should at least check your own articles for typos.
Having said that, well done for getting Releaselog back online. We're all grateful for your effort, and we know you did nothing wrong, even if your soppy web hosts don't think so!

kodabar: The domain is registered to Bite IT (well, the same address), their web design company. It's a pretty common thing to have a single company taking care of the web presence, including hosting and domains, so if that's the case here, the registration is actually correct.
Now, DDoS is illegal that's true, but it can be done in ways that's very hard to backtrack. The simplest way is to find a file storage site that allows comments and allows html in those comments. Now upload something really popular and in the comment include an 1×1 iframe that loads something like their mainlogo.jpg (22KB) of simply their front page through a referrer-stripping service, and advertise the download someplace nice and busy… Now sit back and watch their Microsoft-IIS/6.0 based site go down in flames… All hits will come from thousands of random IP's from all over the world. There's no referrer to give up where the link came from, and each downloader won't notice the few extra KBs when viewing the loaded comment. This attack cannot be stopped because there's no way to find the page from where the iframe loads the site, and should it be stopped through random events, just repeat as needed. Javascript can also be used of course.

we the down loaders first try out what we see or hear and if we don't like it of course we don't buy it

Never heard about franz and never will. It must be crap since it doesnt ring any bells. Post only about quality releases and you dont get attention. This doesnt include Enya, Franz and some boybands who release best of albums like backstreet boys, nobody cares about them except their labels who hire web sheriffs (lol what an job is that, as pathetic as being chinese farmer for some game!)

I think you deserved to be shut down for a little while, not because of the content (that was a silly request on their part) but ecause of your replies to the e-mails they first sent you.
Being cheeky doesn't help anybody, I've often found that barking right back at them with sharply written emails that show your understanding of your website's rights and the law (and confident talk about your lawyer and your legal rights) will usually make them think a little bit harder before they start talking to your host company.
Host companies are pussies, they will usually take down your site until youve dealt with the situation, so I avoid letting it all get to them.

If the entire problem was a link posted by visitor, that visitor was WebSheriff.
And, yes. The folks at WebSheriff operate on the same principles as any other human being. Violence towards the weaker. Google is safe by sheer size. This is not an issue of morality or legality. It's just simple cowardice.

nice to see you back. sad that this happens, but please notice that quite often the companies fighting to protect copyright are the same people wwho manufacture the blank media and the recorders (yeah sony, i mean you!).
think of me in new zealand, whre a new law mwans that anyone ACCUSED of downloading copyright material of any sort will be cut off by their isp. no dialogue, no trial, just an immediate cessation of service. what a crock. we have ordinary users, isps, copanies and everyone else going crazy about this stupid, unworkable new law, but our"democratic" government is just rubber-earing the lot of use and ploughing on with the worst piece of legislation regarding the internet ever.

Yeah, with a site like this being viewed 100,000+ times a day(?) maybe just maybe dns failover might be a good idea.
This site is so terribly huge? It's a wordpress blog with images… Dude I have a site that takes 4 hours on a 100mb line to copy from server to server (transfers). Unless you have a database of 10gb+ and over 500,000 images, it's not.
Personally, I think this story is a bunch of croc. Web Sheriff can be a nuisance, but they do NOT have the authority to shut down a datacenters bandwidth to servers, especially since I believe this site is hosted in the NL. At the MOST they can send DMCA notices which are sent to the datacenter who then typically forwards the notices to the end users renting the servers. No one would ever just shut down a servers bandwidth without notifying them first.
So, the moral of this story is bullsh!t.

Well, I understand that they want to remove all FF mp3s on the net because of their profite, BUT, if there would not be any piracy FF albums on the net I would probably never ever hear about such a band. I like them (I don´t love them) and if I would see a CD of FF in some shop in our (Czech rep.) country I would buy it but there aren´t any
) It´s the same with movies. If I really like some I will buy it on BD or DVD. The same with apps, tv shows etc. So I think in some smaller countries piracy is even good for bands, movie makers or software companies
