RIAA goes crazy: mp3 ripping is illegal

effrey Howell of Scottsdale stands accused of placing 54 music files in a specific “shared” directory on his personal computer that all users of KaZaA and other “peer-to-peer” software could access — pretty standard grounds for an RIAA lawsuit. However, on page 15 of a supplemental brief responding to the judge’s technical questions about the case, the RIAA’s Phoenix lawyer, Ira M. Schwartz, states that the defendant is also liable simply for the act of creating “unauthorized copies” — by ripping songs from CDs. “I couldn’t believe it when I read that,” New York lawyer Ray Beckerman told the Washington Post. “The basic principle in the law is that you have to distribute actual physical copies to be guilty of violating copyright. But recently, the industry has been going around saying that even a personal copy on your computer is a violation.”

In other words, according to Schwartz’s logic, every single person who’s ever “ripped” a CD for portable listening on an iPod or other MP3 player could be liable for astronomical damages. Apple itself estimated earlier this year that only 4 percent of music on iPods worldwide had been purchased through iTunes, implying that most of the rest had been ripped from CDs. In October, Jammie Thomas, a Minnesota single mother, was ordered to pay the record companies $220,000, or $9,250 for each of 24 songs a jury found she’d shared online. Are these twats totally out of their mind? Putting a lawsuit against someone who legally bought a CD and then ripped it to mp3 so he can listen the songs on his mp3 player, that’s the last proof of how idiotic this bloody company is…

    There’s already people suffering from the extreme stupidity of this law in Finland :) Basically if you buy a CD here and make any kind of copy from it, shall it be to your car or to your mp3 player, then you’re making as big of a copyright violation as stealing the god damn CD from the shop in the first place.

    There was a big controversy about this, but nowdays nobody really cares about it and most don’t even know such law exists.

    When this law came in place, the politician who strongly wanted the law to go through was given an mp3 player as a christmas present for her kid.

    Ksawery, you say you dont have to worry bout the RIAA cause you live in the UK? Think again man as they have entered into an agreement with Interpol and they can come at you in England just as quick as they can here in the states, all they have to do is have an attorney over there on retainer and you can be charged under English law. Check your London Times or the Gardian as both have had stories about people being nailed for posting songs to the net, and prosecuted by the RIAA under English law.

    maxposting, all you have done with your post is show your total ignorance. If you would have bothered to use your keyboard and check instead of letting your mouth over run your brain and common sense, you would have seen that the RIAA are located in New York City and California. Both of which are the two most liberal states (progressives as they call themselves now) in the US. As such while they may be crazy assed Americans, they clearly are not “rednecks” And calling someone a “redneck” to their face here in the states would be a VERY good way to need a dentist as it is just as offensive to people here as it would be for me to call you a burking arsehole if I were in England.

    As you think of it RIAA is a terrorist organisation. What are they against? Invisible people sharing something without harming anybody. What are they accused of? Preventing multimillionaires to win a few more millions. In that case, inflation and stock market, also government expenses and taxes must be caught and put behind bars.

    Just look how much damage they’ve done! It’s true i’m downloading some albums. But if i dont download them, i’m not going to buy them either.
    Think about closed communities. Think about demonoid. That was just hell good of a community i visit everyday, and learn way too many movies, bands, comics i didnt even heard of.
    IRAA is against people and against culture. In that way they’re against development, freedom and of course future!

    In Norway, creating MP3 files for personal use is legal. Similarly, copying a friend’s CD is legal as long as you make the copy for your personal use, not for distribution or sale. Great, isn’t it? You’re even allowed to download MP3 files from the net as long as you don’t sell or distribute them. … gotta love Norway!!

Hopefully once that happens and the RIAA moves in to ban all MP3 players and the MPAA sets in to discontinue DVD players that can play -R disks the supporters will realize its hopeless and insane.

    What I do not understand is that people actually make a copy of their original CD to prevent it from getting scratched… It’s like using an old pc instead of your new laptop because you’re afraid it’s gonna crash or get damaged. It’s supposed to be used, duh! And then there is this other group who download a DVDrip movie and when they like it, they ’say’ they buy it in stores. What’s the use in that?! So then you have two perfect copies of a movie, and only use the downloaded one because you’re probably afraid to get the original one scratched. Kinda twisted from my perspective, lol. In this world there are multiple ways to intrepret FREEdom… I’ll just interpret it my way ;)

    its not legal to download anymore, they changed that law awhile back. it’s a commonly believed otherwise, however, this is not the case anymore.

    There is no justice in this. The US has become Land of the Free Market, Home of the Knave. Isn’t this the second poor single mother targetted? What, they couldn’t find any DOCTORS, LAWYERS and BUSINESSMEN to sue for $200k? This is not insane, it’s criminal.

    Anyway, if My Music is the default rip folder AND the default file share folder, then a good lawyer would get her off, surely? They have to prove INTENT! If it was an easy mistake, there’s no case for intent to distribute.

    The RIAA has a specific definition of “authorized copy.” The question is how narrow is it? The copyright law protects the creators’ exclusive rights to control their content distribution but I think everyone should share in that right as long as they’re already profiting and continuing to profit from their work and the end users don’t make money off of their work.

    Another thought – the RIAA should be a “watchdog” but NOT the entity to bring litigation.

    How can RIAA be the plaintiff when they are not themselves damaged? The RIAA does not lose income from piracy. It only REPRESENTS the recording industry.

    Therefore, surely a record label must itself file suit against the defendant, or a performer/band must.

    All I can guess is that the RIAA is a watchdog turned bulldog, taking all the heat so the labels and artists don’t themselves get a bad reputation. How this can be justified is beyond me, as is targetting the people LEAST LIKELY to know how to defend themselves.

    The entire process is evil and callous and completely out of order, it should be thrown out of court. People should bring a class action to the RIAA for … causing undue hardship… terrorism… something!

    You buy a book. That copy is yours. Other copies belong to other people. Use it as a doorstop, burn it, eat it, but you’re not allowed to create photocopies for your friends.

    You own 1 COPY of the material. In the real world, this is called copyright. If you were a musician or artist trying to make a living, you would understand.

    The evil side is how management of artists’ rights has turned into a moneymaking business in itself by middle-managers with no imagination and a control-freak streak a mile wide. That’s why, in a mass-production consumer market of millions, we still pay AU$30 for 12 songs, 10 of which we don’t necessarily want.

    This story is actually false. The man being sued IS NOT being sued because of “ripping” cds, but rather he is being sued for downloading mp3s of albums he does not own. Check it out.

    Anyhoo, some heartening reading about past _failed_ RIAA law suits. Seems actual recording industry damages are seen to be around $0.70 per song, not $9250. The precedent is set. RIAA is losing its teeth real quick.

    Very true. It’s not responsible “journalism” to just blindly report on a story without doing any research. Especially in this case, when the story makes no sense. I first read this rumor yesturday, and was so shocked by it that I immediatly looked into the validity of it, and discovered that its not true. The RIAA is NOT suing ANYONE for ripping CD’s that they purchased. Also, RLSlog, just an FYI, the RIAA is not “a company”. But rather a collection of companies all in the same industry.

    This has been known for a while. In the EU, unless your state signed up to protect you ripping music it is indeed copyright infringement according to the Copyright Directive. If anyone’s interested I’ll dig up the relevant sections of the Directive and implementing legislation for the UK.

    The main problem is that the RIAA is blind to the fact that they are the cause of this. When CD’s came out they charged MORE for the exact same music on a cheaper medium. Their greed caused people to lose faith in the industry, this in turn allowed people to easily justify downloading pirated music.

    They should apologize to the public for being greedy and short sighted and then lower the prices that they charge. Only a complete freaking idiot would disagree. If that’s you then I am sorry…mainly because I know that you will probably win a Darwin award one of these days.

    The most important thing most people are missing is that the RIAA is getting your personal information by forcing your provider to give it up in connection with your ip. Now correct me if I’m wrong but in Canada that is called the breach of the right to privacy and therefore the provider can in no way be forced to give up its clients personal info to the douche bags.     Also, it looks awkward when you writers try to integrate your own opinion in with the actual news article. It’s always out of place. Just some constructive criticism, not meant to be insulting or anything. I’d recommend quoting the source, and then starting a new paragraph for your own opinion.

    The reason is because the final paragraph goes on to talk about a woman that was sued, and then suddenly, it gets to your opined bit wherein you start talking about the previously mentioned court case. The structure is just terrible.

    I read a discussion of this issue on another forum, where Ray Beckerman was actually participating. I skimmed over most of it, since it got rather long and technical, but the jist was this;

    Ripping CDs IS making an unauthorized copy, however it is not classified (yet) as copyright infringment. All the use of the word “unauthorized” means is that the record company did not specifically authorize people to make MP3 (or whatever) copies of the music, even though they currently have the right to do so under the USA’s “fair use” doctrine.

    The discussion partcipants agree on this point, but disagreed on the RIAA’s reason for bringing this up. The article’s author seemed to think that they just wanted to have the ripped files classified as “unauthorized” so that he could be formally charged with distributing unauthorized copies. Ray Beckerman seemed to feel that the RIAA had something more under-handed up its sleeve and that they’re trying to get the judge to rule that people don’t have the right to rip CDs for their own, personal use.

    Either way, unauthorized doesn’t equal illegal, at least not yet…

Another thing; I always find it strange to see people whos native language is English (UK/USA) lacking skills when it comes down to structure and vocabulary (not pinpointing any staff-members though, just mainly the people who comment around here). When people like that are starting to make a point, I find myself not taking them serious lol. I’m just wishing that will change around here. ;)

    Also… why purchase the CD (if you don’t use the CD), when it is being offered online a lot cheaper? I know many does this. They purchase the CD – rip it – then transfer it to their mp3 player.

    But of course, it that music is being shared, that’s the users fault. But I try to steer clear from that stuff.

    Pc torrents dont just ruin companies – its also radio and terrestrial t.v – why go out and buy a season when that season is currently bieng aired on t.v. or why go out and buy a single when youve just recorded it onto tape off the Top 20? MPAA, RIAA whateverAA, deep down there glad about PC downloading because its the only way to prove 100% that somebody has got a copy of a product without purchasing it.

    If companies are so bothered about profit why dont they ban it bieng aired on t.v/radio? Thats easily where alot of % profit has been missed out on – not just PC downloading.

    I get the feeling that people think these knuckle-headed ideas come from the USA because it is some EVIL entity run by the devil and his white, male assistants. It seems somewhat obvious to me that these desperate actions come out of NY and LA because that is where all of the “rights” to all this entertainment is held. Duh. If Swedes were potentially losing millions off of pirating, I’m sure they would lead the world in these actions also..

    I’m not justifying this stuff, don’t get me wrong. There is NO WAY to get this genie back in the bottle. The battle is lost and they refuse to see it. I just don’t see it as some innately American idealism here. I don’t have any problem with anyone being happy they are from where they are from. Just be sensible enough to realize the reason the US is leading this insanity is because entertainment is the last great American industry and they refuse to let go of the cash cow happily. It’s not as hard to figure out as all that.

    Again, most of you are missing my main point. The law suit in question is not about “ripping” music from ones CDs. The sources RLSlog cited or not correct. This case is a matter of downloading and uploading music illegally, and has zero to do with the ripping of CDs.

    I used to buy a CD on occasion out of guilt, for a gift or out of a desire to support an artist I really liked.

    *Sigh* After reading this thread from start to finish, I can see that the massive majority of the people that post replies are equal to children calling names in the schoolyards.

    If the posters that keep stating that “we cannot be prosecuted because we live here” would get off the couch and check the local laws at the library, they will see that there is almost no place in the world that the RIAA cannot reach via Interpol and their agreement with them. The RIAA has already tried to prosecute people in the Netherlands, HAVE prosecuted and convicted people in Russia and Brazil. Had out of court settlements in England and Australia. Got the Mounties and the Canadian Government to close down or block some p2p sites for music. I mean my God people, Prince (with the backing of the RIAA and the International federation of the Phonographic Industry (the international version of the RIAA) has filed suit against the Pirate bay in the US-France-Israel-Sweden (and has added the UK and Australia to this suite) http://www.news.com/8301-10784_3-9814504-7.html and he is going after p2p people. So just because you dont live in the US does not mean that the RIAA and their cabal cannot reach out and tap you on the shoulder and then snatch your ignorant rears into court. And if you think this cannot happen to you, then God help you as you are lost.

    As for ripping a copy of your cd or movie for your own personal use, that is allowed already in the US and has been for the last 30+ years. I guess all you so-called experts have not even bothered to check out the US Supreme Court “Betamax” decision handed down in the 1970’s that gave a person the right to make copies of TV shows-movies (via vhs tapes then) and music for their own personal use. That law is still in effect today.

    If this is the best the schools can do is turning out obvious no-nothings who rant first and check the facts later, then God help us as humanity is doomed.

    Does the ruling still hold up and is the ruling all inclusive for digital media, and digital recording technology, because the ruling was originally for tape recording.

    First off, this news isn’t “fake”. While the RIAA is suing him for having files in his shared folder, they are actually referring to ripping CDs as illegal in their legal documents… which is significant.

    Secondly, saying the RIAA is a company is technically incorrect, but not far off. They are a trade group that represents the spectrum of major American recording companies. It’s not like people are completely missing the point by saying “company”. We all know it’s the actions of large corporations that are pushing the anti-piracy front.
