Perezhilton.com shut down for copyright issues

While many people still think the internet is uncontrolled and unwatched, it’s getting harder and harder to have a popular website while you breach some copyright laws. From my personal point of view, it’s worst for sites hosted on US servers – other countries still don’t watch these legal problems so carefully, but it’s getting tighter every month. We also receive tens or may be even hundreds of mails every month because of NewTorrents, and although we are not hosted in the USA so we aren’t obligated to listen to those requestes filled under DMCA law, we actually delete almost every requested torrent (well our ISP does if we don’t do it anyway). Reuploading the very same release in some different torrent is the other thing. :) I’ve also received few emails requesting content removal of some posts here at Releaselog, but I denied them all – we are a clearly informative site with 0 bytes of copyrighted material and therefore I don’t see any persuasive reason why should we delete posts from here.

A popular blogger known as Perez Hilton has similar problems recently. His Sydney based hosting company received a whole bunch of similar mails from one of the biggest photo agencies. The Web site was down for several hours Tuesday, and by Wednesday was back up but being hosted by a different Internet service provider, but without all the articles, as noone probably made the database backups. The gossip columnist, whose real name is Mario Lavandeira, is the target of several lawsuits by paparazzi and others who claim he posts their photos and video content on his site without permission. Celebrity photographers make hundreds of thousands of dollars selling exclusive images to magazines and Web sites each year. The agencies that have sued Lavandeira say he has refused to pay fees to license the photos, claiming he has a right as a journalist to use the images for free. Los Angeles photo agency X17 Inc. sued Lavandeira in federal court last year, asking for $7.6 million in damages. The suit claimed Hilton used 51 photographs without permission, payment or credit, including images of a pregnant Katie Holmes, Kevin Federline pumping gas and Britney Spears. The case wasn’t decide yet. Anyway, it’s pretty much same as with enforceing someone to shut down his (illegal) site. Although MPAA probably doesn’t agree with this, 2 or more other sites will pop out when you close something, so it’s really just about the time. And the warez scene is a pretty good proof of that theory…

    I just don’t get this. How much money do Katie Holmes, Kevin Federline ect. get for having their pics used?

    If I take an unauthorized picture (cause I doubt the celebrity involved will sign a release) it becomes my property? And if someone else puts it up on the internet, I can sue them for MY property?

    Does that mean I could take an unflattering pic of someone famous, and then, instead of selling the exclusive right to a magazine, I could instead sell the exclusive rights to that celebrity? Uh… Isn’t that called blackmail?

    Ya, famous people make a ton of money and it’s hard to feel sorry for them (*waves to Paris Hilton) but this kind fucked.

    Well…I think that everything that is “reachable” on the internet, that means that you can get it without forcing anything, is public information so public share.

    And well..that’s right that if you wanna make it public again, than you should at least mention the source site, but usually nobody does that for some reasons.

    Martin you are in the wrong.. the post title would give the impression that PerezHilton.com has closed permanently when infact its still online. You should have kept the topic relevant by putting that first paragraph about RLSLOG later (any excuse to plug RLSLOG ..*yawn* whens that going to get old?) and moving the paragraph about PH first. Next time re-label it something more approrpiate like “Perezhilton.com changes servers” which is all that it really was about and given that it was in the media like 4/5 days ago – please dont post OLD news.
