Yes, if someone doesn’t settle when they get the blackmail letter, then the RIAA files a lawsuit. At that point, they get a subpoena to examine the person’s hard drive.

If they find any copyrighted files, or evidence that you’ve used file sharing software, that proves you’re guilty.

If they don’t find any copyrighted files or evidence that you’ve used file sharing software, that proves that you destroyed evidence because you’re guilty.

Isn’t it nice how that works?

I might not be a hacker, but I would think it wouldn’t take much to high jack someone’s connection. I don’t see how anyone could have a lawsuit off of only an ip address, now if they had hard evidence such as hard drives or burnt discs, then they would have a solid case.

Whatever the outcome, you can be sure that the RIAA will be buying some laws to get around any judgements against it. For example, the idea of “making available” being equal to “unauthorized distribution” is currently being challenged in court. The RIAA and MPAA are trying to get laws passed which make “attempted copyright infringement” a crime. This would effectively make it illegal, no matter what the judges decide now.

This is the kind of Discovery we’ve needed for a long time. Whether file sharing is piracy or not, that does not give either the RIAA or MPAA the right to break the laws protecting people from extortion, racketeering and fraud. All of which, I believe, the RIAA is guilty of committing. And if it were me filing the law suit. I’d attempt to have any lawyers who knowing participated in these crimes, be they practicing lawyers or simply executives with law degrees, disbarred.

yea well RIAA gotta stop suing people over innocent downloading. Downloading an album isnt an alternative to buying it because i wouldnt buy it either way. And MediaSentry busting people by using Megashares (mediasentry pops up on PG2 blocklist)

Someone was afraid that Tanya will settle the case. Well,maybe! But it is also possible that this is a case of principle and that money isn’t the issue. If she has a solid case than I think she will go through with it until these people really get punished. Only time will tell!
