Lawsuit to possibly reveal RIAA secrets?

Things will get very ugly over the next few months for the RIAA, if one disgruntled file sharing lawsuit victim gets her way. Tanya Andersen, the single mother who filed a countersuit against the RIAA after the organization mistakenly sued her for sharing music online, attempted to hold it responsible for all sorts of heavy infractions. RIAA could be forced to release potentially incriminating details about its techniques for investigating alleged file sharers. This information would likely be held under a confidential seal, but if lawsuits over mold, tobacco, and asbestos are any indication, the RIAA’s secrets will likely leak out into the legal community at large, potentially culminating in a class-action lawsuit.

Once Tanya Andersen files her amended Complaint, which the RIAA is barred from contesting this time around, the organization could have to explain the following details by producing documents and allowing major-label anti-piracy executives to be deposed:

- How much the RIAA’s lawyers make
- Why the average file sharing settlement fee is $4-5K
- How it decides which file sharers to sue, and which ones not to sue
- Where the settlement money goes (i.e. whether any of it makes it to the artists)

If it turns out that the RIAA is paying its investigators (such as MediaSentry) a percentage of the settlements that result from their investigations, it is in even more trouble.  That’s illegal in many states, according to Ratoza, including New York. Even without a class action lawsuit, the RIAA nutshell is likely to split wide open after Andersen’s case hits the discovery phase, causing problems in subsequent cases.  Ratoza expects the discovery phase in Andersen’s case to start in about 90 days, and said it will last 4-6 months.

    If no body knows - the swedish anti-piracy-company (privately owned and went freely around and charged people for illegally downloading music/movies/games/whatever); they were sued big time, and went backrupt. Google it ;).

    Although I applaud the lady for fighting back as I have done in the past, but dont hold your breath for a good result against the “alphabet gang” because in the real world of “Politics & Law” in the USA if they offer her $1,000,000 out of court she will say “thank you very much sir .. that will do nicely”
    & if she doesnt they will just buy their way out of it as big companies always do…

    Someone was afraid that Tanya will settle the case. Well,maybe! But it is also possible that this is a case of principle and that money isn’t the issue. If she has a solid case than I think she will go through with it until these people really get punished. Only time will tell!

    yea well RIAA gotta stop suing people over innocent downloading. Downloading an album isnt an alternative to buying it because i wouldnt buy it either way. And MediaSentry busting people by using Megashares (mediasentry pops up on PG2 blocklist)

    This is the kind of Discovery we’ve needed for a long time. Whether file sharing is piracy or not, that does not give either the RIAA or MPAA the right to break the laws protecting people from extortion, racketeering and fraud. All of which, I believe, the RIAA is guilty of committing. And if it were me filing the law suit. I’d attempt to have any lawyers who knowing participated in these crimes, be they practicing lawyers or simply executives with law degrees, disbarred.

    Whatever the outcome, you can be sure that the RIAA will be buying some laws to get around any judgements against it. For example, the idea of “making available” being equal to “unauthorized distribution” is currently being challenged in court. The RIAA and MPAA are trying to get laws passed which make “attempted copyright infringement” a crime. This would effectively make it illegal, no matter what the judges decide now.

    I might not be a hacker, but I would think it wouldn’t take much to high jack someone’s connection. I don’t see how anyone could have a lawsuit off of only an ip address, now if they had hard evidence such as hard drives or burnt discs, then they would have a solid case.

    Yes, if someone doesn’t settle when they get the blackmail letter, then the RIAA files a lawsuit. At that point, they get a subpoena to examine the person’s hard drive.

    If they find any copyrighted files, or evidence that you’ve used file sharing software, that proves you’re guilty.

    If they don’t find any copyrighted files or evidence that you’ve used file sharing software, that proves that you destroyed evidence because you’re guilty.

    Isn’t it nice how that works?
