Demonoid forcedly shut down by CRIA

It has been no longer than 6 weeks since our latest report about Demonoid, which scared thousands of its users. The site was taken offline by Canadian Recording Industry Association (CRIA) that time, although many people thought it has been just technical issues with Demonoid’s servers. As a result of this closure, this popular tracker had to block access to all Canadians – they were simply getting timeout messages in their attempts to contact the server.

Now, when everything looked safe and sound, the site is offline once again. CRIA sent a threatening letter to Demonoid’s hosting provider (Netelligent.ca), which resulted into shutting down the whole site. Demonoid’s tracker still works and ironically wasn’t affected by this latest issue, although it’s the essential part in the process of downloading content through BitTorrent. According to the official IRC channel of this popular site, Demonoid administrator is already working on returning everything back to normal. I wouldn’t wonder if they decided to move their servers to different country and hosting company though, the pressure on p2p applications in Canada is increasing every week…

    For those who yell “they will never stop online-piracy”, think about this: A legal letter to the provider, that’s all it takes!

    See how easy it becomes for “anti-piracy” (or “pro-grabbing-huge-amounts-of-money-from-the-industry-b*st*rds” as I like to call them) to take down torrent sites? This is just the beginning. The only good thing is that Demos (THE MAN behind Demonoid) won’t stop, but just tries again and again. I really like Demonoid. It’s a great place for quality torrents. I really hope they will be back soon.

    you clearly dont know what happend at TPB becouse the police did raide it yes BUT they did brake the law bye doing so becouse its not illigal to have a tracker.

    AND they have ther own ISP!!!

    named prq so they dont care if they get a leagl letter becouse its the same owners…

    November 9th, 2007 | 16:03

    a legal letter is just a piece of paper, it doesnt really do anything to stop online piracy as a whole, sure they might get a website to go offline but there are thousands of other ways to get warez or movies. Do you really think just because they stop 1 website others are not going to popup ? Its a war they will NEVER win. They have been trying the same thing for years now and all its done is made people go underground.

    Demonoid will be back up sometime soon, maybe a day, maybe a week, maybe a couple of weeks, maybe a month, but it will be back up. They need to move the servers to Africa or South America, some place where they have more worries than people sharing files with each other. File sharing is just crippling the Canadian government. The country is in complete turmoil over this situation. It affects education, crime and poverty. YOU CAN UNDERSTAND WHY THEY DID WHAT THEY DID, CAN’T YOU??????

Used to think I was a somewhat smart Canadian , now Im not so sure ( lol ) . Anyhow , could anyone out there either explain to me or send me links on how to go about doing such a thing , it would be greatly appreciated , and if and when Demonoid is back up and I can access it , I will send invites to those in need of one that helped me with this topic. if Demonoid removed all music content, then what would the CRIA be able to do?

    it’s just bullsh*t though. the record labels are scared because they didn’t embrace technology and use it properly, so now their outdated business model is failing faster and faster it’s a sinking ship. face it, no one in the music industry needs record labels any more. especially not when you see them waste money for people like J-Lo, Michael Jackson, and Britney Spears.

    Man, why don’t the webmasters of “questionable content” such as BT just outright eliminate legal risk – host from Greece. Unless things have changed quite recently, there is absolutely NO COPYRIGHT LEGISLATION whatsoever in Greece. So even if you offered direct downloads of copyrighted works, who’s going to prosecute a legal activity? None of this “we’re technically legal” crap that doesn’t seem to matter in todays legal system, just cut out the legal system altogether by staying completely legal.

  76. Darth Arcon
    November 9th, 2007 | 20:35

    Hmm…well this blows. CRIA can go ffck themselves…

    What I dont understand is why they would do this kind of thing TWICE! First they require restriction to Canadian users, now they shut the entire site down. What prevented them from trying this the first time, and why do they have the ability to do it now? Obviously, something has happened that we dont know about, maybe a new law passed or something…

    Anyway, I think the best move would be to mimic TPB. TPB has been the biggest p2p protector in existence…hmm…..Maybe TPB should host demonoid! They already have two of the most popular public torrent sites already, why not add a private site (not to mention the most popular private site)?

    If something isnt done, Im going to be upset. After all, I love demonoid!

  77. James
    November 9th, 2007 | 20:47

    I’m sure torrent sites are prepared for these kinds of bumps in the road and are enacting “plan b”. Ultimately, sites like Demonoid are going to have to get with the program and invest in private/self-perpetuated ISPs. If a letter to the provider can shut down something as big as Demonoid they’ve gotta be thinking about ways to avoid this in the future.

  78. z@ph0d
    November 9th, 2007 | 20:47

    Jesus no – don’t let TPB anywhere near Demonoid. That’s the single BEST thing about Demonoid – they’re NOT run by TPB. Not that there’s anything wrong with TPB – but do we really need another dump site with ZERO organization and no expectations that what you’re downloading will be safe or accurate. TPB is good because everything under the sun shows up there. Demonoid is good for exactly the opposite reason – you don’t have to wade through a ton of crap before you find what you’re looking for.

    Not to mention the Demonoid community is just awesome. Public trackers completely lack this sense of community. It’s a shame that people will only act like decent people when they’re being forced to do so.

    This really only occurred to me this very minute – what right does the CRIA have stirring up trouble for Demonoid or anyone else for that matter?! Thanks to the levy imposed on blank recording media “pirating” music in Canada is a COMPLETELY LEGALLY PROTECTED activity. I could understand if it was the CMPDA (Canadian Motion Picture Distributors Assoc) as the laws cover music ONLY, leaving movies, software, etc still protected by copyright. So by the CRIA’s own insistence, copying music is ENTIRELY LEGAL in Canada. In other words any legal “threats” that Demonoid has received from the CRIA are not valid, are not enforceable, and could very well constitute harassment. If I was running Demonoid I’d fight the action and couter-sue for harassment and legal expenses.

  81. z@ph0d
    November 9th, 2007 | 20:59

    @lord74:

    We always could. Demonoid’s method of screening out Canadians was none-too-thorough. A simple transparent proxy residing outside of Canada is all it took. It didn’t even have to be an anonymizing proxy.

  82. z@ph0d
    November 9th, 2007 | 21:07

    @novakink:

    Do your homework numbnutz – we enjoy plenty of freedoms. Many are not shared by many of our so-called industrialized nations. For example, you can’t be thrown in jail here just for saying “gee, I wish the Prime Minister was dead”. Try that in many other countries (including America) and see what happens!
    Name me just one freedom that’s common in other countries that we do not have in Canada.

    ISP’s are in the worst way in this whole digital millennium crapola. If they comply and obey, the public roasts them alive. If they refuse and deny requests to name names, then THEY are being held accountable for the actions in question – that’s the way the laws are starting to swing in many countries. I feel for the ISP’s – I truly do.

    That being said, tho, I’d swear a mortal enemy of any ISP that would cough up ANY info about me to ANYBODY for ANY reason (besides the info that it transmitted as an integral part of the whole TCP/IP mishmash for the nerds and retentives out there). It’s just really crappy that they are being put in the position to have to do so more and more these days. It’s a HUGH scare tactic that’s been working like a charm for RIAA, and will serve many other xIA’s very well in the future. It’s the laws that need to be addressed in all fairness, not the ISPs (with the notable exception of AOL – they need to be addressed to a deserted island and sent postage due with no return address).

    Since the Supreme Court of Canada already threw out the case against Canadian Citizens downloading in Canada, I doubt they have any legal authority. Since the Supreme Court sets precedence, I would look at this as a harrassment suit, and suggest the wonderful people at Demonoid file a suit againt them. Legally they are doing nothing wrong, they are not selling and therefore are not criminals.

    How about freedom to buy yourself personal health insurance? Only countries in the world that forbid that are Canada, Cuba & Korea… Luckily I think you’ll spend less time waiting for demonoid to come back than you would waiting for cancer treatment.

    @Matt:

    You kinda picked a moot point there bud.

    First of all, we have a socialized health care system – think NHS in Britan – so any lifesaving care and the majority of hospital procedures are paid for by your citizenship (it’s managed at a provincial level financially, but the majority of the rules of the system are federal making the same system available across the country).

    And secondly, for the stuff that’s not provided for by the federal system (ie free) like prescription drugs, elective procedures, etc we DO in fact have personal health insurance. There’s several insurers that sell private plans for $x.xx/month similar to the US approach but not as sweeping in scope. But there are many insurers that sell through Employers’ benefit systems. At least a basic level of health insurance coverage can be expected for little or no cost in this Country just by having a full time job. Most employers offer tiered levels of these benefits by co-pay with the employer typically paying at least 50% of the premium of the selected plan.

    If there’s only one thing I was allowed to be proud of it’s our health care system. It has its faults, for sure, but I wouldn’t trade it for the world. I just hope we can keep the American uber-corporate influences the hell OUT of our hospitals.

    And before someone craps the taxes BS out there pie holes, NO WE ARE NOT TAXED TO DEATH. The taxes we pay are perfectly reasonable – especially when you consider what we get back in services for our tax dollar. Right now, my tax bracket leaves my paycheck about 20% lighter. That’s all gov’t deductions included – federal tax, provincial tax, employment insurance and “old age” pension premiums. And I get about 4% back through mandatory vacation pay that my employer is responsible for. Not a bad system. Not perfect, but FAR from bad.

  97. z@ph0d
    November 10th, 2007 | 00:03

    Ahh- i see what you are saying – we’re not allowed to pay money in order to have our treatment priority increased. All I can say to that is: No we can’t, and shame on you for even contemplating the morality of doing such a thing. That’s the very thing that makes me so much want to vomit when I think about the way some countries run their health care. Why would you tolerate, let alone want to, live in such a system?!

    What about the outrageous amount of taxes that you pay in Canada for that so called “privilege” of only being able to accept medical care from a government sponsored agency?

    Even the horrendous British system isn’t that restrictive that they forcibly prevent their citizens from purchasing medical care if they would like to.

    “What!?!!! This is preposterous! An organization trying to protect their interests from being robbed of their living!”

    You ignorant, corporate tool. First of all, the CRIA has nothing to gain from this, it’s all power moves and chest-inflating. Secondly, I know I don’t know you, but I’m pretty sure you’re not as rich as Britney, Justin or 50. Yet you’re defending their and their labels right to make millions upon millions of dollars from people who barely stay above the poverty level. How many times have you spent hard-earned money on a crappy movie or cd? How many times have you felt like you wasted money? If you feel gyped learn to live with it because that’s your only choice. That industry does NOTHING to guarantee your satisfaction. Most stores have a no return policy on movies, music and books. So for years they’ve been tricking us into buying cd’s or getting us into movies knowing damn well they have a product that’s mediocre at best. Well, I got a bit sick of spending my money on crap with no guarantees, making myself poorer while the rich get filthy f’n rich. This is my payback. I’VE been robbed by “Hollywood” too many times. I don’t care if Tom Cruise doesn’t get his 35 cents because I downloaded one of his DVD’s (I probably wasn’t gonna buy it anyway). Besides, I as I’m sure others have, have enjoyed certain things I downloaded so much that I went and bought them. Like I said, I’ve been burned in the wallet too many times and this just allows me to weed out the crap I wouldn’t want to spend money on. Like ‘Hot Rod’.

    @z@ph0d

    Well, one freedom you don’t have in Canada is to hold on to your own money. The government demands you give it to them so they can hand out subpar “free” healthcare to all 33 million citizens of Canada.

    Come to America, where we allow people the freedom to decide for themselves if they would like to spend their money on health care or not. If you’d rather use your money to buy a new 60″ plasma tv instead of healthcare, you can. In Canada, you can not. Thats just one example, like you asked for.

  107. Alfred
    November 10th, 2007 | 01:20

    @BrotherJustin

    It’s a little different than that. If you order a dinner in a restaurant, and you don’t enjoy it, you can’t just ignore the check when the waiter brings it. You still have to pay.

    Same thing with buying a movie or music, after you’ve watched or listened to it, you can’t just say “I don’t like it” and not pay. If that was an option, everyone would go to a movie theater and demand their money back on the way out after watching a movie.

    And you said that defendeing the “labels right to make millions upon millions of dollars from people who barely stay above the poverty level.” is anything near reality?? The label doesn’t have a “right” to make any money at all, they offer a product for sale, and people have the choice to buy it or not.

    And if someone is barely above the poverty line, they might make better choices to spend their money on than music and movies. In fact, if they watched less movies, they might have more time to make money and get out from under their poverty.

  108. Sasserworm
    November 10th, 2007 | 01:26

    I don’t think the amount of money going to the government to pay for a Canadian persons health care can be compared to the price of a 60 inch plasma. Plus go watch SiCKO it compares all health cares to USA.

    @ lee welton

    It would be so nice to live in a country like the USA, where only the wealthy can afford to pay for the insanely over priced cost of health care. I would love to live in a place were money comes before my health. It seems like such an ethical system. It would be great to live in a place were half the bankruptcy is caused by health care costs….It sounds like such a nice place to live.

    Canadian’s have plenty of choice when it comes to health care. We can choose whichever doctor we want, and we can go where ever we want for treatment. The only thing the government is involved in is the payment. True we can’t choose a private insurance company, but why would I want to have a for-profit company screwing me as I’m lying in a hospital.

    So with all the money I save I can go down to the States and buy that 60″ plasma. It’ll be half the price too, because the almighty US dollar isn’t so mighty. Then I can watch Corner Gas from my “free” hospital bed…. if I can find an open one.

    Come on guys, I covered this one pro-actively. Read post 96 all the way to the bottom. Feel free to sound out the bigger words if they give you trouble.

    And good luck affording that 60inch plasma TV after your cancer diagnosis – you’re gonna be in debt up to your eyeballs right up ’till you die. Or you could always just buy the TV, ignore the cancer, and die all the quicker. You can’t watch TV from the grave. Christ, even an appendectomy will put you in debt to the tune of a small house! Ya, great little system ya got there. Enjoy it.

    Having lived in both the States and Canada, I have to say on a purely anecdotal basis that I’ve always gotten far better and prompter care in Canada than in the U.S. So go ahead and make yourself feel better by pretending there’s no choice; it’s like car insurance, in the province I currently live in there’s only private car insurance but we get f**cked in the ass for it, whereas in B.C. the rates are faaaaar better and nicer to the consumers because of ICBC (a provincial crown corporation). So, yeah, they don’t get the choice. Thank gods I live in Alberta where we can can pay huge amounts of money to the provider of our choice, hooray!…..

    Somehow I don’t think it’s a good idea to entirely deregulate essential/needed services. Look at the push by the ISPs against Net Neutrality, for example. The consumer doesn’t really have a choice, but if the CITIZEN could have an impact…. if it came down to a straw poll or a referendum I’m quite sure that there at very least wouldn’t be strong enough support in Canada to shut down torrent sites like Demonoid, but because even in this “socialist” (yeah right) country power in that sphere is in the hands of an industry organization rather than a governmental/democratically-based one sites that are even technically legal are being shut down. For shame. If Canada was really as communist and lefty then we wouldn’t be having these problems with Demonoid and other such sites (like the IMSLP; check it’s website or its wikipedia entry for THAT tale of industry triumphing over laws and individuals)!

    What I don’t get is that the CRIA has absolutely no legal right to shut down demonoid. The CRIA already agreed with the Canadian government that they would get a portion of the sales of all blank media sold in Canada in exchange for the revenue they would lose by people downloading music in Canada off sites like demonoid. They made their deal and now they want to ignore it cause they are greey bastards who want more money. Seriously demonoid should fight it in court because as I said they have no legal right to do this.

    Never wanted a Canada vs US debate, much less a health care debate. When posters started attacking Canada and Canadians over this whole CRIA nonsense I simply challenged them to back up their claims. The best they could come up with was uninformed blasting of our taxes and health care. I don’t quite know how that arose from the initial question of us lacking basic freedoms. That was the initial statement that I challenged (and am still waiting on a valid response to if anyone actually has one). I’m not trying to claim any sort of superiority, just to disprove this unfounded claims.

    “They need to move the servers to Africa or South America, some place where they have more worries than people sharing files with each other.”

    One of those worries is not having the internet infrastructure or hosting services to be able to do such a thing.

    Personally I can’t think of any worse place on earth than Africa.
    Another one of those “worries” they have is will the US withhold the aid they depend on because of a policy decision they’ve taken which annoys the US.

    “What I don’t get is that the CRIA has absolutely no legal right to shut down demonoid. The CRIA already agreed with the Canadian government that they would get a portion of the sales of all blank media sold in Canada”

    The levy Canadians pay on blank media has absolutely nothing to do with Demonoid or the illegality of it’s operations.

    The Canadian levy on CDs means nobody will be prosecuted for making a copy of a CD they own for personal use.
    That’s it. Nothing more.
    All P2P falls outside this exemption.

    So they have as much legal right to get demonoid shut down in Canada as they would in the US.

    All good things come to an end. Demonoid was the best out there for rare and hard to find torrents. Sigh. This leaves a dark day for us and for what? Ah, the almighty dollar, yes now I remember. I remember a time when I bought cassettes and actually taped music off this free thing called a radio without any reprecussions of either myself or the radio station getting shutdown. What’s next a house to house search for every recordable device in america?

    Some words for non-internet loving companies: This is how it works. Whatever you sink, we build back up. Whomever you sue, ten new pirates are recruited. Wherever you go, we are already ahead of you. You are the past and the forgotten, we are the internet.
