Apple sues Psystar, MAC cloning company
When Florida-based Psystar, a small startup, announced that it was going to make Mac clones for dirt cheap, many rolled their eyes — they’d heard that line before. During Gil Amelio’s tenure at Apple, clones were briefly allowed, but when Steve Jobs returned to the company he carried out a campaign to purge the market of every last clone. So when Psystar announced a $399 Mac with strong specs comparable to a $949 Mac Mini desktop, many figured the end was near for the company. These thoughts were put on hold about whether Psystar would deliver, as some found a handful of evidence to indicate the company might be a farce. However, Psystar proved itself to be real, shipping units to reviewers. It also unveiled a small server lineup to compete with Apple’s niche offerings in the server market.
Not anymore. With Steve Jobs manning the helm, Apple filed suit against Psystar looking to destroy it as it has destroyed many which came before. The suit was filed July 3 in federal district court of northern California. Apple accuses Psystar of violations on shrink wrap license, trademarks, and copyright infringement. Much of this revolves around the fact that Psystar will preinstall OS X for you; a move which legal analysts said would put it in peril. Details of the complaint are finally emerging. In it, Apple tries to paint itself as simply fed up about missing components on the computers, allegations that Psystar was trying to promote itself as an Apple product, and claims that it was concerned about Psystar’s quality control.

@4 I think That is still illegal because legally you can only run OS X on a Apple product with its logo(And a Apple sticker doesn’t count) something along that line was in the EULA I think although I haven’t read that myself just heard about it.
Any ways why would want to buy a computer with Mac OS X on it and not get support from Apple if something with the hardware isn’t working with OS? If you do you have to rely on Psystar to come out with a patch for it not Apple since some different hardware may have been used.

I can run Crysis DX10, everything maxed out at 60+ fps (u need more anyways? no).

Screw monopoly, the problem with Psystar is not the cloning of apples, it´s much more simple, Location, Location, Location. Go and setup your company in China, Russia or anywhere in South America out of the reach of any greedy bastard named Jobs, Gates or whatever. Then we´ll talk business. Not only you´ll be better located outside U.S.A., you can hire child laborers at dirt cheap prices and really make some profit! (Just kidding about child sweatshops, cause that is actually a sad reality in my country).
My god #29, I have a pc and I have a mac, and I can assure you that I will NEVER soil either one with the over complicated, poorly designed crap that is linux.
And apple would obviously make far more money if they let others use mac os x, but in the end of the day, they want to ensure quality, and not just quality of the actual machine, but the continued quality of Mac OS X. Supporting lots of hardware is exactly why most mac users don’t like windows. If windows only ran on a small amount of hardware, it would run great, be more secure, faster and more optimized, but because microsoft has chosen to license windows for all PCs, they have sacrificed alot of these things that they would otherwise have better. It’s definitely good for their profits, but in my experience the only things that run better on PCs are games. Also to the person who said apple has a 500% profit margin, they don’t. It is actually under 100%, which is still much higher than most other pc manufacturers including Psystar

IMO, i used both Macs and Windows. Ive noticed that Premiere and a lot of the Adobe stuff runs faster on Windows.

Profit margin for apple PCs are only around 30-40%, which still is quite high.
I calculated for myself, lets say Newegg is cheapest retailer in the US for computer parts. I took all the specs of a generic Mac Pro (which costs $2799).
Getting all the single parts from Newegg would only cost me approx $2000 to create the same spec computer. This would equal to around 30% profit margin then.
However lets say add 5-10% for wholesale cheaper parts for Apple. Therefore profit margin would equal as much as 40%.

Well, because of Apple’s suit against Psystar, I am now aware of Psystar and have spent some time looking at there products. I like what I see. Very well priced machines with any operating system you want. If after this lawsuit Psystar is still in business I think the next computer I buy will be from them, probably loaded with Ubuntu.

I’d love it if phystar was able to continue selling and hopefully expanded internationally, as apples local prices are just too much when you can get much more bang for your bucks from clone PCs running windows/linux.
I have used linux fairly extensively, and depending on what you do, it simply isn’t practical. Not enough of the big games come out on Linux for one thing, which I’ve always found odd as the Linux niche and Gamer niche seem like such similar people.
As far as what I’m running? I’m running Vista. Why? On my old desktop, it ran everything about 10X faster than the XP install I had on before (on 512ram even). I would get the occasional blue screen with XP, but I haven’t seen a Vista blue screen yet, and I’ve been running it since Beta (how I didn’t get any in Beta, I’ll never know). As for why I’m running it now? Simple. It came on my new laptop. It is the restore partition I use once a month or so, so it just keeps things simple.
Dont be fooled by Apple, they are not the good intentioned company they make out to be. I purchased several Psystar servers for my company then went out and purchased several copies of Apples operating system to install on them. They have been running flawlessly with great tech support, but by some strange twist apple found out we are running thier OS on these computers and I was served with papers to shut down the computers due to an illegal copyright infraction. That may be why Psystar is recalling them. I bought the computers and the OS systems but because I cant fight apple I am going to be out more money, they are railroaded me and Psystar into bankrupcy. I hope to god someone can do something. About a week before I got served I had a electrical inspector in the needed to see the power supply to my Lan room. After having called the city, there was no inspector that was sent out,,,could that man have been from Apple?

I’ve always known that, in general, Mac is better (and BSD, for example, better than both). But I cannot ignore that Windows is everywhere and that there are many many many more developers targeting it. The volume of choices for Windows’ users is impossible to beat right now.

It is a shame that some people are convinced Linux is for “geeks” and overly complicated. The benefits certainly outweigh the negative. I have been involved in computers for 30 years, seen many things come and go and have had the pleasure of watching Linux develop into an amazing O/S. I love playing games and migrated from the PC/Mac as a game machine and use PS3 and Xbox 360, I was tired of games outpacing the PC. A friend who is a PC game fanatic asks me to set up games for him, which is not that difficult to do with his Kubuntu system. Just my thoughts. BTW English is my fourth language.

how does this work? Apple is over-priced hardware with some realy good software (based on sales… im not a mac fan personally) they conceded that the personal “ibm” type pc market is just farther ahead so they base their design on pc specs. So its easy for a startup to come along and take some pc hardware and i dont know how but put a Mac OS on that hardware…

Also Linux is awful for gamers as well as older people. For windows you can find so many programs and install easily. There is no need for hassle. Same for Mac’s i would say.
I own a Macbook Pro as well and i really love it. I think its good that there is a monopoly on it. One hardware means stability.

First off, Apple sure as hell doesn’t have a monopoly. Second, the fact you can build a vaguely-faster PC for the same money is irrelevant when the computer doesn’t have as intuitive features.
Everyone in the industry rips off Apple, and sucks ass at doing it. Remember when the first iMacs came out? All of a sudden everyone in the world was using those fruity colors for their hardware/peripherals. Remember when Mac computers/laptops had the built-in webcam (iSight)? They were the first widely-used machines with a built-in webcam that wasn’t a huge ugly piece. Even now, if you look at the latest Dell or Sony machines, they are so obviously trying to rip off Apple’s sleek design and usability, but they always are totally off the mark.
Anyway, what Psystar was doing 100% opened them to legal liability, mostly civil-suit liability but… regardless.. they got what was coming to them.
btw the cases Psystar was using (As pictured in this article) were the ASUS TM-210 and TM-211 , for black and white respectively.
I actually built my home PC just under 2 years ago in a TM-210 case.
@41: If you don’t want Linux stuff on your Mac you better uninstall most of your OS. OS X takes a vast majority of its stuff from the OSS community which is dominated by Linux. You also better uninstall Apple’s native browser (Safari) since it uses the KHTML render engine which was developed by KDE, a Linux GUI company.
@61: If you think Linux is for games, you got serious problems. Linux is for serious programming and sysadmin’ing. For games, not so much.
The reason the gamers and Linux people look alike is because it’s all about performance. Gamers want the best performance out of their systems and Linux gives the best performance out of the hardware. So you got some hardcore gamers trying damn hard to make Windows games work on Linux.
Actually, this is totally pointless argument. Every system has its of benefits and down sides. Like quite many people, I use both OS daily.
Personally, I prefer OSX for every day use. Internet mail etc. It just feels much more comfortable and humane. I can do 99% of the stuff on my Macbook Pro. I’ve been using it for 3 yrs and very satisfied.
Windows is still good for business solutions and serversMostly because of aspx and .net… though OSX is already doing good, but not good enough…

I love how an Apple user can actually state that their OS X is more secure… as I can recall from an Apple security contest one was sort of hacked under 1 minute ? Like 20 seconds or so ? Even though freedom of speech is an amazing thing, one should tend to keep his mouth shut when he actually knows nothing about a given subject. OS X is secure because its market corner being so small and nobody caring enough to try and crack it wide open.
And yes, Apple is greedy, so is Microsoft. Also, yes, Linux is better if you take the time to learn about it.

Again, their problem. They are the ones with a serious lack of options when it comes to software and the ones who pay top buck… and all of it while they convince themselves that Windows explode because of hardware incompatibilities… how can you not smile?
